Third Judicial Circuit for the State of Missouri

The petition of Louise Vincent
a Woman of Color aespectfully showeth
that she is about thirty years of age that she
was born a slave in the State of Missouri
the property of Autoine. Bouis deceased that
she coutinued to live as a slave with the
Widow suffering of said Bouis after his death
until the year 1829 when she was sold at
public sale and purchased by one Joshua
Pahlin , she & her three children, Adalphe
Marcelline and Maria for the sum of seven hundred fifty dollars. That some
time after she & the children were bought by
said Pahlin , he took them to the state
of Illinois where he resides, and they there
remained with him for about the space
of fifteen month. That said Pahein
died about three or four months since that
recently your petitioner returned to this State
and since her return has been claimed and
held as a slave by marie P. Ledue esp the
administrator of said Pahlin . The said
Ledue Excusing authority over her as belonging
to the estate of said Pahlin . And
your petitioner prays your honor that
she may be permitted to bring suit under the
laws of this state as a poor person against
said Ledue for his freedom and your Petitioner
will pray.

said Louis before and Since the commission of

Ledue she the said being a free person as aforesaid
on the day and your last aforesaid with
did hold and still goes hold her as a slave

upon her the said Louis then and there did make
and then and there beat bruised and illtreatedher
the said Louis and then and there imprisoned her
the said Louis and kept and detained her in
prison there, without any resonable or probable
Cause whatsover for a long space of time towit

of this suit Contary to the law of this
land and against the will of her the said

Louis have reasonable liberty of attending the Court and her counsel when occasion may require
it and that the be not removed out of the Jurisdction of the court - during the pendency of this

Personally appeared in open
Court Louisa Vincent the said Plaintiff and made
oath, that same time since, as well as this affiant
can recollect about four years ago she was
purchased from her former owner Madane Vincent
Louis by G Joshna Pahlen , that at the
same time said Pahlen also purchased from
said Madame Bouis the said Adolphe and
said Marcelline then and now minors who are
the children of her said louse, that some
time after she and her said children were purchased
by said Pahlen as slaves for life

In took her and her said children to the farm
of him said Pahlen in the that of Illinois , near
the Rapiol of the Des moins River, about the
distance of between two and three hundred
miles from the leity of St Louis ; that she resided
with said Pahlen at his said farm in the
state of Illinois as his slave and performing
for him menialservices as such, for the person
of four months during which time her said
children adolphe and marceline lived
with her on the farm of said Pahlen
at the place aforesaid of
. This affiant as well as the
can recolect believes that it is about three
years since the resided on the fam of
said Pahlen for four months. This affi
ant further states that, at different period
of time since the last mentioned date she
has lived as the servant and slave of said
Pahlen , at on said farm
and also at the trading first of said Pah
len on the northern side of the des moins
River out of the limits of the state of mis-
souri and hespond the limits of any parti-
cular state, or territory of the United States . This affiant further states that prison
to the institution of the said suits in the name
of herself and her siad children against
the said Marie P . Ledue she informed
her counsel arthur L. magrni that she
should be able to substantiate the facts

above set forth by the testimony of Mr. Char
ler D. St Mrain that before applying to
the judge of the St Louis Circuit Court
for permission to being said said said
counsel called upon said St Mrain to state
his knowledge relative to the fact of her
said accidence and that of her aforesaid
Children in the State of Illinois and north
of the said River Des Moins as the slaves
and property of said pahlen that said
. St Mrain made an affidavit in cetation
to the facts (which affidevit is now on fib
in this Court and which she prays was he
taken and read as a part of this statement
that she was informed by her said counsel
and believes the fact to be so that it was
upon the affidavit of said St Mrain that
the judge of said Court made the order
permitting said suits to be brought against
said sedae. This affiant further state,
that said Pahlen died about a year
and that as she has been informed and believes
administration of his Estate was granted
to said sedue by the county court of the
county at St Louis and that on the return
of this affiant about Eight months since to St Louis
said sedue as administrator of suid Pah-
len took possession of her and her said
children as slave the property of the Estate
of said Pahlem, and has continued to exercise
control and authority over her and them
since that time at slaves belonging to said
to said Estate. This affiant further states
that she was informed by her said counsel
that the facts set forth in the said affi
davit of said St Mrain were sufficient
if not contradicted to establish the claim
of herself and children to freedom and
that it was unnecessary to resort to other
proof. That affiant relied upon the le-
gal knowledge of her said counsel, and
that said St Mrain would in giving testi
mony before the court and jury at the held
of said cause prove the same facts for
which he had made dath in his said affi-
davit, and in consequence thereof she did
not endeavor to obtain other evidence to main
tain the issue on her part. That your affi-
ant was wholey surprised to born that
the evidence of said St Mrain materially
varied as given at the trial from the
affidavit previously made by him. And
this affiant further states that she verity
believes she can establish the fact of
her residence & that of her children form months coith said
Pahlen as his slaves on said farm in
Illinois , by the testimony of sames white
and his wife who than and affiant
believes now reside in the state of Illinois
contiguons to said farm of said Pahlen
that said white lived next neighter to said
Pahlen during the time this affiant of her children resided
as his slaves in said state of Illinois for

said space of four months & also at other times
when she and her said children lived with said Pahlen as his slaves, both
in Illinois , and beyond the limits of the state
of missouri north of the Des Moins River .
This affiant further states that she verily
believes that she can obtain the testimony of said white
and his wife by the next term of this court
and also the testimony of other individuals,
(to the same effect) whose names are

court arthurLmagrins and made oath that
he was employed as Counsel in said causes that
before the institution of said suits this affiant
had several conversations with Charles. D . St .
Vrain that said St Vrain on the request of
affiant made an affidavit upon which
an order was obtained from the of this
court permitting said suits to be brought that
this affiant had the sole management of said
causes committed to his case, that before and
subsequent to the institution of said suits affiant
had repeated conversations with said St Vrain
who on every and on all occassions informed
him that he said St Vrain well know said plaintiff
and due Joshua Pahlen to whom the
said plaintiffs had belonged as slave, that he had
frequently seen said plaintiff in the possession
as said Pahlen at the form and residence of
said Pahlen in the state of Illinois , and that
for a considerable space of time, that is to
say for several months, & during which time
said Louse performed menial officer for and
was treated by, said Pahlen , as his said slave
this affiant further states, that in consequence
of the information devined form said St Vrain
relying upon his testimony and knowing him
to be a residant of the city of St Louis he did
not that it was necessary to look
for other testimony in order to sustain the
issues on the part of the said plaintiff
that this affiant inquired and could not find
that there was any other person residing with
in the juridiction of this court by whom
he could prove the same facts which
he an understood from said St Vrain could be
proved by him, that said plaintiff Louise
Vincent is an ignorant person genticaly
relied above the legal skill and professional
fidelity of this affiant to couldnot her said
cause, and was entirely governed in the con-
duct thereof by his openion and advice this
affiant further states that it was at his in-
stance and on his promise to manage the suits
of said minor Adolphe and Marcelline
that said St Vrain consented to appear us
thin next friend. This affiant further states
that at the trial of said cause of said Louise
this affiant was wholy surprized by the
testimony given by said St . Vrain which not

only materially varied from what he informed
this affiant he could substantiate, but which
as affiant considers materically varied from the statements contained in the petition of said
plaintiff the hath of which petition was
veried by the affidavit of said St . Vrains
which petition and affidavit are on file
in this court and which this affiant prays
may be considered as making part of
this statement. And this affiant further
states that from the information which he
has received from said Louise and from
statements which have been made to him
by persons who knew said Pahlen he verily
believes that at the next term of this court he
will be able to establish by competent
testimony that said Louise and said Mar-
celline and adolphe resided at the farm
of said Pahlen in the state of Illinois
for several months during the ligetime
of said Pahlen under his control and per-
forming services for him and that since his death
said Ledue has claimed them as slaves as this ad-

I Suwe Garland of Law feel age
being produced sworw & Examined on the part of the
plaintiff in the above case Deposith & sap. that he has
had a knowledge of the residence of the above
named Louise Vincent a woman of color that she
has resided to his knowledge at Zoot Edwards in
the county of Hancock and state of Illinois , and
to the best of his knowledge and belief he the said
deponent says that the said Louise Vincent did
reside in the county & state as aforesaid serving
a certain Joshua palen well known to the said
deponent as the acknowledged master or owner
of the said Louise and that the period of the
residence of said Louise as aforesaid was he
believes contimned beyond forty days, at divers
times during his acquaintance with said Louise .
And moreover the said Deponent further saith
that the aofresiad Joshua Palen did purchase
a possession or interest in a claim of land
in company he believes with a certain Capt of as
white of Hancock to Illi , at the read of the Desmoine
Rapids, and was recognized by said white as a
