Missouri Littleton a poor
person complains of William Lttleton of
a plea of trespass assault and battery and
false imprisonment for that heretofore to wit
on the eighth day of June in the year one thous
and eight hundred and forty six at the County
aforesaid with force and arms upon the body
of the said plaintiff the said defendant an assault did make and then the said
plaintiff “did then” and there beat, wound and
ill-treat and did then and there imprison and
restrain of her liberty for a long space of time
to wit for the space of one year against the will
of the said plaintiff and other wrongs the said
defendant then and there committed against
the said plaintiff to the great damage of said
plaintiff to wit in the sum of one thousand
dollars and therefore, she sues.
And also afterwards to wit on
the same day and year aforesaid and to wit
the County aforesaid the said defendant with
force and arms seized took the said plaintiff
and imprisoned her and kept and detained
her for a long space of time to wit for the
space of one year against the will of the said
plaintiff and the said defendant did then and
there compel the said plaintiff by means of
the force and false imprisonment aforesaid
to work and labor for the said plaintiff for a
long space of time to wit for the space of six months the next following against the
will of said plaintiff, and the said plaintiff
says that before and at the time of committing
the said grievances the said plaintiff was and
still is a free person and that the defendant
held and still holds her in slavery to the
damage of the said plaintiff in the sum of
one thousand dollars and therefore she
brings suit.

We command you to summon William Littleton , if he be
found in your County, that he be and appear
before the Judge of our Circuit Court , on the first day of the next term thereof, to be
held at the City of St. Louis , within and for the County of St. Louis , on the third Monday of November next, then and there to answer unto Missouri Littleton ,
of a plea of trespass, assault, and battery, and false imprison
ment
to the damage of said plaintiff one thousand
dollars: And have you then there this writ.
Witness, John Ruland , Clerk of our said Court,
with the seal thereof hereto affixed, at office, in the
city of St. Louis , this eighthday of
June in the year of our Lord eighteen
hundred and forty six.

by his attorny, and defends the force and injury
when and says, he is not guilty of the said
supposed trespasses in manner and form as
the said plaintiff hath above thereof alleged,
and of this he the said defendant puts him
self upon the County

And now comes the defendant
and moves the Court to dismiss this suit for
the reason, that the said plaintiff is a person
of Colour and the slave and of the defendant, suing
for the freedom, and has not filed security
for the costs as the law of the land requires.
And because the statute in such cases
made and provided has not been complied
with by the said plaintiff before the institution
of this suit.
