William Clerk by his at
torney, complains of John Roach of a plea of
trespass on the case, for that whereas the said
defendant heretofore to wit on twenty first day of
april in the year eighteen Hundred and thirty
four at the County aforesaid was indebted to the
said plaintiff in the sum of five Hundred dol
-lars lawful money of the United States for so much
money by the said plaintiff to the said defendant
before that time lent and advanced to and paid
laid out and expended for, the use of the said
defendant and all his special instance and request
and being so indebted, he the said defendant in
consideration thereof afterwards to wit on the day
and year last aforesaid at the County afore-
said undertook and then and there faithfully
promised the said plaintiff to pay him the said
sum of money above mentioned when he the
said defendant showed he thereunto afterwards
requested. nevertheless the said defendant not
regarding his said promise and undertalking
hath not as yet paid to the said plaintiff
the said sum of money above mentioned
or any part thereof but to do the same hath
hitherto wholy neglected and refused and still
doth reject and refuse to the damage of
said plaintiff five hundred dollars and there
for he brings his suit & c.

Before me Archibald Gam -
ble Clerk of the Circuit Court for the County
aforesaid, personally appeared Merrithewether Lewis
Clark and made oath that John Roach
the defendant named in the within declaration
is justly indebted to William Clark the plain-
tiff named in said declaration in the sum of
One Hundred & eighty dollars of a real sub-
sisting and unsatisfied debt, being due to him
said Clark by said Roach for the cause
of action set forth in said declaration &
being a part of the same sum in said de-
claration specified and that he verily believe,
said Roach is about to remove his effects
out of this state.

We command you to Attach John Roach
by all and singular has lands and tenements,
goods, chattels, moneys, credits, and effects, or so much thereof as shall be
sufficient to secure the sum of One Hundred and Eighty dollars
with interest and costs of suit, in whose
hands or possession soever the same found, in your bailiwick, that the said
John Roach
be and appear at the next term of the Circuit Court , before the Judge there

of, on the first day of said term, to be holden at the city of St Louis , within
and for the county of St. Louis , on the Fourth Monday July next
then and there to answer unto William Clark
of a plea of Trespass on the case
to the damage of said plaintiff of Five Hundred
dollars: And also that you might summon all and every person, in whose
hands or possession soever, any such lands, tenements, goods, chattels, mo

neys, credits or effects may be found, and particularly
that they be and appear
before the judge of our said court, on the first day of the term aforesaid,
then and there to answer unto what may be objected against them; and have
you then there this writ.

John Roach in the hands or, possession of James
Kiernan, by declaring to him in the presance of John

Mc Cousland, who is a creditable person of the neighborhood
that by virtue, of this writ I did to attach the same
& summoned him as by reading to him
the writ & declaration in the presence of the said
Mc Cousland, done in the city of St Louis on the
24th day of April 1834
