greeting

We command you to summon Francis De Rauin,
that he be and appear before the Judge
of our circuit, court at the next term, thereof to be
held, at town, of St Louis within and for the County,
of St. Louis on the second monday of October next,
then and there, to answer unto, Louis Beaudoin ,
of a plea that he unto said plaintiff the sum,
of two thousand dollors which he owes to and
unjustly detains, from him, to the damage of said
plaintiff fifty dollars and have, you then there, this
writ,.

hundred eighteen and, of our independance, of the United States the forty third, A Gamble Clerk,

to have of the said Dependant
the further, sum of four hundred dollars
to writ at the place aforesaid whereof the
said Dependant afterward to wit, on the
same day and year last aforesaid, and had
notice, whereby an action hath occurred,
to the said plaintiff to damand have of from the said Defendant the said last
mentioned sum of four hundred dollars
other of the said sum above diman-
ded. Yet the said Dependant although
often requested so to do hath not yet paid
the said sum of two thousand dollars above
demanded or any part therof to the said
plaintiff, but hath hitherto, wholly refused
still, doth refuse to the damage of the said
plaintiff of fifty dollars and therefore
he brings his suit, -

St Louis county ss. Louis Beaudoin plaintiff in this
suit complains of Francis Denouin Defendant
in this suit of a plea that he surrender to the
said plaintiff the sum of two thousands dollars
which he owes, to unjustly detains from
him: for that whereas the said plaintiff &
the said Defendant, to wit on the thirteenth
day of july one thousand eight hundred of
sixteen at St Louis in the county of St Louis
of within the jurisdiction of the court made
their certain And or writing obligatory, duly
executed by the said defendant of the one part
and the said plaintiff of the other part-
sealed, with the seals of the said plaintiff
of the said defendant and which said dud
or writing obligatory, being in the possession
of the said Defendant the said plaintiff can-
not produce the same to the said court here
By which said dud or writing obligatory
the said Plaintiff agreed to enter into the service
& employment of the said Defendent as a
trader and to go up the Missouri river and
its to trade with the indians
for the said defendant, and to continue in
his employment as such trade untill the
month of june then next. And the said

Defendent by the said dud or writing obliga
tory promised to pay to the said plaintiff
for his said services,, as such trader, four hun-
dred dollars, to be paid upon the expiration
of the said term of service,: and the said Plain-
tiff saith, that immediately after the exe-
cution of the said And or writing obligatory, he
entered into the service, & employment of the
Defendent as a trader, to wit at St Louis aforsaid
and that he proceeded up the river Missouri
its according to the of
the said Defendant and traded with the Indians for the said Defendant, in all things following
his istructions, and continued
in his employment as such trader untill
the month of june then next, to wit the
month of june one thousand eight hun-
dred seventeen; and untill the full end
of term of the said service had expired-
and that he did in all things perform & ful-
fill the undertaking on his part to be performed
& fulfilled, according to the true intent of meaning
of the said agreement as contained in the said
dud or writing obligatory. Yet the said Plaintiff saith that the said Defendent although
often requested hath not as yet paid the said sum
of four hundred dollars to the said plaintiff or any
part thereof: But hitherto, hath wholly refused,

and carried, on a-
mong
the Indian tribes according, to the
directions, of the said, Defendant and
continued, in the service, of the said defendant, as such trader, performing all the
duties, in cumbent, upon him to do and
perform as such trader untill, the month
of June one thousand eight hundred &
seventeen. and untill his said term, of service was,
completely expired & ended,
yet the said, Defendant altho, often requested,
hath not paid to the said,
plaintiff the said, last mentioned four
hundred dollars, of the said debt first, above mentioned or any part
thereof, but to pay the same hath hither,
to wholly refused, & doth refuse,.

And whereas, also the said, Defendant
afterwards, to wit, on the fifith day of August in the year,
one thousand eight hundred & seventeen at St. Louis
last aforesaid,
at the place, & within, the
jurisdiction, aforesaid was indebted, to the plaintiff, in the further, Sum of four hundred
dollars, for the wages, of the said plain-
tiff
for his service, before then done &
performed by him the said, plaintiff as
a trader, among the Indians for on

of the said Defendant and for his benefit,
and at his of request. And
to the paid to the said plaintiff by the said
Defendant when he should be thereunto,
aterwards requested, whereby by reason
of the said last mentioned sum of money
being & remaining wholly unpaid, an
action hath occurred, to the said plaintiff
to demand have, of from, the said
Defendant the said last four hundred dol-
lars parcel of the said sum above demanded

And whereas also afterwards to wit on
the same day of year last aforesaid, at
the place and within, the jurisdiction aforesaid,
the said plaintiff at the like special instance,
of request, of the said Defendant
had before that time done, & performed
certain,> work & labor, for the said defendant
and had been in his service & employment
as a trader among the indians and had
served, him for a long time as such trader
to wit the term, of one year, he the said,
defendant undertook, & then & there saith-
fully promised the said plaintiff to pay him there
for, so much money as he therfore reasonably,
deserved to have when he should be thereunto afterwards requested. And the,
said plaintiff that he for reasonably,

and still refuses, - whereby, an action, hath
occurred, to the said plaintiff to have and
demand of the said, Defendant the said,
sum of four hundred dollars parcel,
of the said debt, above demanded

And for that whereas, the said, Defendant heretofore, to wit, on the thirteenth day,
of July in the year of our Lord one
thousand eight hundred & sixteen at the
place & within, the jurisdiction, aforesaid
by his certain other dud, or writing
obligatory sealed, with his seal (but,
which said dud, or writing obligatory,
being in the possession, of the said defendant,
the said plaintiff cannot produce the,
same to the said court here) promised,
& agrred, to pay the said, plaintiff four,
hundred dollars to be paid to him in
the month of June, thereafter or upon the
completion, of a trading, voyage which
the said, plaintiff had undertaken, to
make for the said, Defendant, up, the
river Missouri , & among the Indians
in that quarter, And the said plaintiff
saith, that the said, trading voyage was complted & ended, in the month of
june, one thousand eight hundred,

& seventeen, Defendant had
- yet the said Defendant although often requested, hath not yet paid to the said,
Plaintiff the said sum of four hundred
dollars last, mentioned or any part thereof,
but hitherto hath, wholly refused & still refuses,

And for that whereas, the said Plaintiff
afterwards to wit, on the same, day & year
last, aforesaid at the place & within the
jurisdiction, aforesaid at the appointment & request, of the said Defendant
had agreed, to enter into the service &,
employment of the said Defendant as
a trader, - and to go up the Missouri River, to trade with the Indians
for the said Defendant and to continue,
in his service, & employment as such trader,
untill the month of June thereafter as such
trader, the said Defendant in
thereof promised to pay the said plaintiff
therefor four hundred dollars - upon the
completion of the said term, of service,
And the said, plaintiff says that he
entered, into the service &, employment
of the said Defendant as such trader upon
the day of year last, aforesaid and proceeded, up the Missouri river,
