County of saint Louis In the Circuit Court of the term of November 1810.
Joseph by his attorney complains of Auguste ,
Chouteau , administrator of all and singular the goods and
chattels, rights and credits, which were of St Paul Lacroix,
deceased, who died interstate, of a plea of trespass, on
the case for that, whereas the said St Paul Lacroix,
his life time to wit, on the fifteenth day of August the
year of our Lord one thousand eight hundred and four-
teen at the county of Saint Charles , court at the
county of Saint Louis aforesaid and within the juris-
diction of this court was indebted to the said Joseph
in the sum of three hundred and seven dollars and
fifty cents lawful money of the United States for
divers, goods, wares,, oil
and tallow, before that sold and delivered
to the said St Paul at his special instance and request and
being so indebted be the said, St Paul undertook
and then and there faithfully promised to the said
Joseph to pay him the said sum of money when
he should be thereto afterwards requested.
And whereas afterwards, to wit on the day and
year aforesaid at the place aforesaid in consider-
ation that the said Joseph at the like special,
instance and request of the said St Paul had before
that time sold, and delivered to the said St Paul
divers other goods wares merchandise
furs oil, and tallow, he the said St Paul undertook
and then and there faithfully promised the said
Joseph to pay him so much money therefore as
the said last mentioned goods wares merchandise
furs oil and tallow, were reasonably worth;
and the said Joseph avers that the said last, men-
tioned goods, wares, merchandise, , oil
and tallow, were then and there to wit at the
time and place aforesaid reasonably worth
the sum of other, three hundred and
seven dollars and fifty cents like lawful money;
whereof the said St Paul then and there
had notice. And whereas afterwards, to wit; on the day
and year aforesaid at the place aforesaid
the said St Paul in his lifetime was indebted
to the said Joseph in the sum of sixty four
dollars like lawful money for money by the
said Joseph before that time laid out
and expended from the said St Paul at his
like special and , and being
so indebted he the said St Paul in consider-
ation thereof afterwards to wit on the same day
and year aforesaid at the place aforesaid undertook
and then and their faithfully promised the said
Joseph to pay him the said sum of money
when he should be thereunto, afterwards requested
yet the said St Paul Lacroix, in his life time the
said several sums of money or any part thereof
to the said Joseph did not pay although often
requested so to do, nor hath the said Auguste ,
Chouteau , since the death of said St Paul
paid the same though often requested ; but the same
to pay hath heretofor, wholly refused and still doth,
refuse to the damage of the said Joseph four
hundred dollars; wherefore he brings his

& seventeen he caused a Subpoena, to Issue, from
the office of the Clerk, of the said circuit court
to the sheriff of the county of St Charles to summon
