This is the last will and testament of William
Clark of the City of St Louis in the state
of Missouri , being of sound and disposing
mind I recommend my soul to almighty
god and dispose of such worldly estate,
with which He has been pleased to bless me
in manner as follows viz

I have given to my son Meriwether Lewis
Clerk the following property viz

1st Cash$ 8000.002nd Land in Clarksville Indiana for which he has been paid$ 900.003rd A lot in said Clarksville Indiana , unsold, valued at$ 200.004th 3 lots inPaduca Ky valued at$ 500.005th Lot No 105 in Jeffersonville Indiana valued at$ 100.006th A Lot in Louisville Ky. Valued at$ 2000.007th About three arpens of ground purchased of G.H.Kennedy
situated in centre S Louis and adjoining lands
of T.J. Payne being in lieu of three hundred and
fifty acres promises him of Marie Gaston valued at3000.008th A Lot in the City of S Louis purchased of
valued at$ 2000.00I hereby give and devise to my said son
Meriwether Lewis Clark his heirs and assigns
a lot or piece of ground with the holdings
thereon in Block No 12, the same wheron I now reside
to include the two rooms now occupied by my
said son with the attached thereto, bounded
by the wall from its foundation up that separates the west
room of my said son from that now occupied by my
son Clark, north, by Vine Street, east by
the eastern wall of my building along said Vine street which
is the western edge of the alley, I hereby direct shall
shall$ 16.700 00To be carried over2 Amount brought over$ 16.700.00Shall pass though my half of said block, to separ
ate my lots on main street from my ground
on the river, or, first street, and south by
a line parallel with said Vine street to its in
tersection with said alley that shall include
said portico valued at$ 3200.00Also a lot in said block No 12 being the
corner of front and said vine streets, twenty five
feet on said front street, extending back wes
terly the same width to the said alley
valued at$ 10.000.00Also the three slaves Cloe Anthony & Ben

To my son William Preston Clark I have

given as follows Clark$ 3000.001st For lands sold in Clarksville Indiana ,$ 1100.002nd Lot no 191 in Jeffrsonville Indiana , Valued at$ 100.003rd Three lots in Paduca Valued at$ 500.004th A lot on main street, St Louis purchased of
valued at$ 1500.005th The three slaves Nancy Henry and
Alexander valued at$ 1150.00I hereby give and devise to my said son
William P.Clark, his heirs and assigns a lot
in Block No. ten, in S Louis foundry main street
on the west, extending back to an ally separating
it from a river lot, with the buldings thereon,
adjoining and south of the lot belonging to the
Missouri Insurance Co. valued at$ 6150.00Also the lot in Block No 12 (the same wheresaid
side) corner of main and Vine streets, extending in depth
to the lot herein devised to my son Meriwether L.
Clark to include with the buildings thereon, one

my other sons allotment, to be deducted from my said son's
Williams proportion, arising from sales of property herein
provided for, an equitable proportion of which to be
refunded to each of my other sons

Indiana valued at$ 300.002nd Lots No 18. 48 64 & 1 in Paducah valued $ 500.003rd Also Lots No 19. 23. 24. 25. 48. 54. 55. 77. 78. 95. 98. 115.
and 116 in Clarksville Indiana valued at$ 350.004th also a lot purchased of Pierre Chouteau Sr . in
Block No. 28. on 2nd Street in St Louis the same
that is now leased to Linch & Frank valued at$ 4000.005th Also two lots with the buildings thereon, in black
No 12 (the same in which I now reside ) the said
two lots are now occupied by W & Beard
& Marrell, bounded, north by lots herein devised
to my sons Meriwether Lewis & Wm P . Clark ,
South, by those devised to G.R.H.Clark and
by the alley valued at$ 18.850.006th Also six hundred acres of land joining on the
north, land herein devired to my son Geo. R.H.Clark, being
part of the Marie Castor tract, valued at.$ 400.00To be carried over -$ 28.000.00

In addition to the above devises, I have given
and do hereby give, to my son Meriwether Lewis
Clark, one hundred acres of land at Marie Castor
To my son William P. Clark, the remaining one
hundred acres more or less of land to be taken from
the west or north line, as the case may be, of the said
Marie Castor tract. To my son George R.H. Clark
three hundred and thirty five acres of land belonging
to me and lying in Montgomery Co. Missouri and
to my son Jefferson my negro girl Rosetta and
all my plate.

It is my wish and I do hereby authorise and direct my
execution or such of them as shall act, to sell at private,
or public sale in such lots, or parcel and on such credits
(not exceeding two years) as may seem to them best,
the remaining part of my ground in said block
number twelve, in the city of S Louis fronting about one
hundred and ten feet on front street and extending back
to an alley bounded on the north by the lot herein devised
to my son Meriwether Lewis Clark, and south by ground
of the estate of the lot of Mississippi , also to sell any
lands owned by me in partnership with William
C. Carr Esq., and three hundred and twenty acres of
land, owned by me, lying or the Merrimack river
From the proceeds of the sale of the above named
property as well as from the debts due or that may be
due me after the payment of my funeral and
other incidental expenses thereto appertaining I devised
that my just debts be first paid and aferwards

there be paid to my son Jefferson Kearney Clark
four thousand dollars, the balance of said proceeds
of sale of property, et cetera to be equally divided
among my four sons Meriwether
and Jefferson taking care, from my son William's
part to refund to my other sons their respective proportion
of the two thousand dollars excess of the amount herein
alloted to each

I further give and devise to my four sons
in equal parts all my Paducah town lots and lands,
including all lands claimed by me south of the
Tennessee river, as well as every other interest or
property, real or personal, that does now, or may
hereafter belong to me always however except

ing, such land lots or property which I have or shall hereafter
convey away by deeds or Bond or otherwise

I authorised and require such of my executors
as shall act, their survivors or survivor to take
charge of the real and personal estate of
my minor son Jefferson Kearney Clark untill
he shall attain the age of twenty one years, and
to invest the money coming to him from rents
or otherwise over and above, what shall be required
for his genteel support and education in
good, safe and profitable stock, or to loan its on
unencumbered real estate at half of the estimated value
decreased by deeds of
or use the whole or part in
proving his lot, on second street, at the expira-
tion of the present lease if believed to be better than
to release said lot. I wish my son Meriwether
Lewis Clark to have charge of the education of
my said son Jefferson

I hereby appoint John O'Fallon
and my sons, Meriwether , William , and

and George , excutors of this my last will and
testament, and guardians of my son Jefferson

St Louis

Your Petitioner Henry Atkinson shows that
unto this court that on or about the twenty third
day of July in the year 1836 at St Louis in the
State of Missouri he was negotiating with William
Clark of the City of St Louis lately deceased for some
in the town of Paducah State of Kentucky at
which time and place and during saith negotiation
William R.Clark the agent and attorney in fact of
said William Clark in the transaction in the presence
of the said William Clark represented that the
herein after described and which are the
same purchased by your petitioner of the said William
Clark had a level surface and were not intersected
nor broken by any That relying upon saith
made in the of the said
William Clark amd assented to by him your Petitioner
purchased composing Blocks four (4) and eight (8)
in the town of Paducah and upper addition to said
town as laid down and numbered on slat filed in
Recorder's Office County of McCracken and State of Ken
tucky for and in consideration of the sum of twelve
Hundred Dollars One Hundred and Twenty Dollars
whereof were paid cash down and for the balance
he executed to the said William Clark his promissory
note payable years after date with interest thereon
at rate of six percent per annum payable semi annually
which note is dated the twenty third day of July
aforesaid and on the same day the said William
Clark executed to your petitioner his deed for said
Clarks in the town of Paducah aforesaid.
Your Petitioner further stateth that since the
execution of said note and deed and payment of
part of the consideration as aforesaid your petitioner has ascertained and asserts the fact to be that
said Clerks are not of and but on the con-
trary are intersected by a deep ravine at least thirty
feet deep running through the front block and then
in two through the other block in rear
of the first making both of little or no value and
finding such to be the situation of the property your
Petitioner has not recorded the deed aforesaid

Your Petitioner further & herewith that he
communicated the facts to said William Clark who said in answer
the matter should be conected so as his son William
& Clark agent and attorney as aforesaid should re
turn to St Louis he being then about. That the
same has not been and the said William
Clark has since departed this life having made
his last will and testament and therein appointed
his son George Clark his executor

But now so it is may it please this
court that the said George Clark admitting the matters
and things herein let forth and stated refuses to pay
or to refund to your Petitioner the sum so paid by
him to the said William Clark and to surrender
to your Petitioner the note aforesaid executed
by your Petitioner to the said William Clark through
Your Petitioner has frequently requested the same
and offered to surrender the deed aforesaid
executed by the said William Clark to your
Petitioner to be cancelled on the grounds
that being possessed of the said note in a repre
sentative character and acting not in his own
right but as executor of the last will and
testament of the siad William Clark deceased

He cannot comply with the request of your Peti
tioner except the same be sanctioned by a
competent Court

In consideration whereof your petiti
oner prays that the said George Clark may be
directed by order of this court to surrender to your
petitioner the note aforesaid the note fore
said executed given to the said William
Clark and to admit the indebtedness of the said
William clark to your Petitioner to the sum
of one hundred twenty dollars with inter
est thereon at six per cent per annum from
said twenty third day of October in the year
1836and allow the same to be against
the estate of the said William Clark to be
paid in course of administration on receiving
from your Petitioner the
to him the said William Clark which
he here submits. to however to be can
celled.

Executor's Sale Of Valuable Lands.

Notice is hereby given that by virtue and authority
of the will of William Clark , deceased I will,
as the Executor appointed by said will. sell at public auction
to the highest bidder for cash at the eastern door of
the court House. In the City of St. Louis and State of
Missouri on Saturday, February 24th 1849, between
the hours of ten and two o'clock of that day, all
the estate right title and interest of the said William
Clark , deceased, at the time of his death, of in and to a
certain tract of three hundred and twenty acres of land,
situate, lying and being in the county of Jefferson and
state of Missouri and on the south side of the Merriamack
river, and near the Junction of the Merrimack and Mississippi
rivers being the same land acquired by William
Clark decessed by deed from Hardy Ware,dated August
11th 1815, and recorded in Recorder's office of St .

On the 12th March 1838 William Clark , William C. Carr
sold their land in Jefferson County Mo it was believed and
understood by both that their bill to the said land was complete
and that the survey thereof made under the authority of the United
States and forwarded to Washington for approval would be so app
roved in the ordinary course of business of the office, this however
not the and a patent certificate for said land was
withheld until about January of February 1844, at the time said
was made the said William C. Carr having become the purchaser
of a part of said land gave his notes therefor to the said Wm .
Clark for his half of the undivided of said land so purchased
the first fo which notes falling due within six months of said
sale amounting to the sum of four hundred, six dollars
was paid at maturity, it then appearing that some difficulty
concerning the title and survey of said land at the
office of Commissioner of lands at Washington no confirmation
of the said title and survey could be procured from said com
missioner until the time above Stated. The said Wm.C. Carr
therefore contends that he ought not to be held to pay the interest
on said notes beyond the time the same matured and called for interest.
Because the consideration for the payment of the said interest had
failed by reason of the withholding of the title at Washington
and the said land being owned jointly by the said Clark
and Carr the said Clark was jointly bound with said Carr
to perfect the title to said land before interest should be claimed
on said notes, said Carr makes no objection to paying the principle
and interest called for by said notes as also the interest accruing on
the same from the date of confirmation of the title to this date but
only objects to paying the interest which has accrued from the maturity of
said notes to the date of the confirmation of the title to said land
in January or February last as above stated.

the mortgage Recorded in Lawrence
County Illinois at least I left it with the judge
for record I have not a letter
from Mr Russel administrator of
the purchaser requesting that a sale
should not be forced under the
mortgage in consequence of the difficulty
of the times The purchaser died two
days before the money became due
Mr Russel lives at in the
same county and he was seventy upon
the notes for the purchase money - You

Russel . I stated that I was very

On the motion of Samuel B Churchill
it is ordered that letters of administration with the
will annexed be granted him on the estate of
William Clark deceased where upon he took the
oath required by law and together with S.M. Flannery
and James C. Calhoun his security entered into
and acknowledge bond in the penalty of ten thousand
dollars conditioned as the law directs.

Clark , deceased, to the Court
executor of said deceased he is in possession of a - number
sixty four (64) in the Roman Catholic Cathedral of this City
which now is in the name and title of William Clark , and now
held by the undersigned to the and benefit of the estate of
said deceared, that no disposition is made of the by
the recorded will of the deceased either by desire or otherwise,
that the same has been heretofore brought to the notice of the
Court upon which the undersigned as executor was authorized
to of the same, which he attempted to do by offering the
same for sale by advertisement in a newspaper of this City
that failing to effect a sale and ignorance of the court he should
pursue in the fulfillment of his duties to the estate of said decd.
in the absence of instructions in the will, and restricted by the
following conditions in the sale of suit by the church, namely,
“If desired to be sold, to be surrendered into the hands of the church
and if sold for more than the original cost the surplus
to go to the church, if forloss, the owner to bear the loss”.
respectfully ask that the Court will instruct him in the matter
thus submitted for its consideration

Know all men by these presents, That,George R H, Clark
as principal,and we John O'Fallon, & William P Clark
as securities,are held and firmly bound unto the
State Of Missouri ,in the full and just sum of Two Hundred Thousand dollars,
to the payment whereof well and truly to be made, we bind ourselves, our heirs, executors, administrators,
and assigns, jointly and severally, firmly by these presents, sealed with our seals, and dated, Saints Louis, this
Eleventh day of October 1838.
The condition of the above obligation is such, That if the above bounden George R H Clark
only acting Executor of the last will and testament
of William Clark deceased,shall well and faithfully execute the said last will and
testament, and shall make true and faithful inventories, returns and settlements of accounts of the estate of
the testator, according to law; and shall, moreover, do and perform all other matters and things touching the
execution of the said last will and testament, as are or shall be prescribed by law,or enjoined on
by the order, sentence, or decree of any court having competent jurisdiction, then this obligation to be void,
and of no effect, otherwise to remain in full force and effect.

Dear Sir

Dr Wilkinson has submitted to me a proposition of
compromise on the Ins cases against him for the balance of pur
chase money due on lots 5 and 11 the proposition is to pay eight
hundred dollars down and give his note 12 months ( secured by the
lien on property) for the balance the interest deducting the
costs of debts the situation of the matter is this - There are two
judgments each fee $ 800 te the collection of which
Wilkinson filed two bills one in this county the in Graves
The security or the bond given here is perfectly solvent The
security an Graves is of no account and of Sam Connelly infor
med has taken the benefit of the Bankrupt law Wilkinson
has nothing which can be reached by excution and the proper
ty of sold into not having enough or more than that satisfy
one of the judgments. In new of these facts I would advise you
to authorize the compromise as it will be vastly better to get
the judgment in Graves paid and hold the property subject for
the balance due there the $ 1600 interest and costs for which
it is now subject - The judgments might be kept suspended over
him, but there is the guarantee that it ever can be made except
by a sale of the property & in addition to the reasons already as-
signed the Dr is much larger claims against him
than this you can reflect upon and let me hear from you
at your earliest convenience I remain as ever

of the will of William Clark , deceased, I will,
as the Executor appointed by said will, sell at public auction

Clark deceased, at the time of his death of, in, and to a
certain tract of three hundred and twenty acres of land
situate, lying and being in the county of Jefferson , and
state of Missouri and on the south side of the Merrimack
river and near the junction of the Merrimack and Mississippi
rivers being the same land acquired by william
Clark, deceased by deed from Hardy Ware, dated August
11th, 1815 and recorded In Recorder's office of St .
Louis county In said state in Book F page 78 and by
from James Smirl by Sheriff dated March 7th 1812,
and recorded in Recorder's office in said county of Jeffer-
son in Book H. page 131 and 132.

America , Two copies of Mc Kenney's History of
the Indian Tribes of North America with biographical
sketches and anecdotes of the principal Chiefs embel-
lished with 120 beautiful colored portraits from the Indian
Gallery, in the Department of War, at Washington .
The above is a rare and elegant production published
by subscription in 20 numbers, each number containing
six large colored portraits the subscription price of which
was $120. or $6 a number.

The above copies, if not previously disposed of at
private sale will be sold at public auction to the highest
bidder for cash at the eastern door of the Court House
in the city of St. Louis , State of Missouri , on Saturday,

is necessary to file the notes we hold in the
probate Court to have then allowed and
by so doing he thinks all the business can
be settled and the money ready by the time
the last payment is due which is the 19th April
1841. before that time he says no more
can be paid In compliance of his
request I have filed certified copys of
the notes including yours (by stating that
belonged to you and in your hands

mortgage taken to secure the payment

therewith, praying for reasons in said petition set out and by said answer admitted that the note
given by said petitioner to said testator for certain lots of ground Paducah which note is dated
twenty third of July eighteen hundred and thirty six for the sum of One thousand and Eighty
dollars payable ten years after date with interest thereon at the rate of Sixpercent per annum
payable semiannually be surrendered, It is ordered that said note be given up to said Atkinson
by said George R. H. Clark Executor as aforesaid to the said Atkinson on his returning to said
Clark the deed of said testator for the lots aforesaid and cancelling the same
