To the Honorable Luke E. Lawless Judge of the third judicial
circuit court holden in and for the county of saint Louis the petition of
Green Berry Logan an infant five years old on the 15th instant
by July alias Julis Logan his mother and next , respectfuly
represents, that his mother the said Judy alias Julia Logan , was,
aboutt twelve years ago the slave of a certain Benjamin Duncan
of Davis county Kentucky . That about the time aforesaid and
while the mother of your petitioner was the slave of the said Duncan ,
she was said by the said Duncan from the state of Kentucky
to the state of Indianna and there hired out to labour as a slave
for four weeks or more. Your petitioner further represents that he
was some time since sold with his mother the said Judy alias Julia
to a certain Berry a man of color who still holds him in slavery. your
petitioner further represents, that the said July alias Julia his mother
and friend instituted a suit for the recovery of his friend in
the circuit court aforesaid against the said Berry
upon the removal from the state of Kentucky and residence
as aforesaid in the state of Indianna, and has recently been
to be untilled to her freedom by a and judgment
of the aforesaid. Your petitioner further represent that he
was from some time after the removal of his said mother from state
of Kentucky into the state of Indianna and long after his
right to freedom accused. Your petitioner further represents that
altho is entitled to his freedom the said holds
him in slavery, he therefore prays that he may be permitted
to sue as a poor person by the said Judy alias Julia his mother and
next friend, in order to establish his right to freedom, that
be assigned him to prosecute the said suit, that such orders
he made and served upon the , and finally
such privileges intended to him as an not inconsistant
the law as in duty found ever pray.

Upon the foregoing petition of Logan an infant, the court
doth order that he be allowed to bring a suit in order to establishhis right to freedom and that F. M. be assigned him as
counsel to prosecute the same. The court doth further order that
the said petitioner be permitted to sue by Judy alias Julia Logan
his mother and next friend, that he have reasonable liberty
to attend his counsel and the court as occasion may require,
that he be not removed out of the jurisdiction of the court
and that he be not subject to any severity on account of
his application for freedom.

Upon the foregoing petition and consent of the said July alias
Julia Logan in writing, she the said July alias Julia Logan is
hereby appointed the next friend of the said Logan an infant
of colorr, to institute and prosecute a writ for his freedom against a free man of color in this court.

in and for the county of Saint Louis - July Term 1836. Saint Louis County to writ

Green Berry Logan an infant of color five years old on
the 15th of April 1836 by Judy alias Julia Logan his mother
appointed by the court aforesaid his next first complains
of Beny a free man of color of a plea of trespass:
for that the said Beny to writ on the 1st day
of April 1831 at Saint Louis in the county aforesaid with
force and arms made an assault upon him the said green
Benny Logan and did then and there beat, bruise, and wound
the said Green Berry Logan and their and then imprisoned him
the said Green Berry Logan in person there without without
any reasonable or probable cause whatever for a long space
of time to writ: from the said 1st day of April 1836until this day during every day. And the said Green Berry Logan
by Judy alias Julia Logan his next friend that
before and at the time of the committing of the said several
greivances he was and still is a free person and that the
said Berry held and still holds him in slavery
contrary to the statute in such cases made and provided
to the damage of the said Green Berry Logan five hundred
dollars and therefore he brings suit &c.
