petitioner has resided ever since until the 25th day of April this present month, when she left Galina , with the
assent of said Taylor , & came to St. Louis , on a visit intending to return to Galina - your petitioner states, that
while at Galina , she removed said George Taylor to one Perry , a resident at Galina -

Being of opinion, that

to authorize the commandment of a suit, I Luke E. Lawless Judge of
the third judicial Circuit, of the state of Missouri , do order that the
within named petitioner, Eliza Tyler , be permitted to sue as a poor
person, to establish her freedom, and for purpose of commencing
and conducting said suit, I assign John F. Darby as her counsel,
and I order that said petitioner shall have reasonable liberty of
attending the court and her counsel when occassion may require
and that the petitioner shall not be taken or removed
out of the jurisdiction of the St. Louis Circuit Court , nor be subjected
to any severity, because of her application for freedom.

July Sum 1835

Eliza Tyler , a woman of color, complains by
Darby her attorney against Nelson Campbell of a plea, of trespass assault and battery and
false imprisonment, For that hencetofore to writ on the twenty ninth
day of April in the year of our Lord eighteen hundred and
thirty five, at the county aforesaid the said defendant with forces and arms an assault
did make upon her the said Eliza Tyler , and did then
and there beat, bruised and ill treated her and her the said
Eliza Tyler , did then and there imprison and held from
them as hitherto, kept and detained her in prison, there without
any legal or probable cause and other damage to the said
Eliza Tyler , then and there did, against the peace and
dignity of the state

And the said Eliza Tyler , owns, that before and
at the time of the said several grievances she was and
still is a free person, and that said defendantheld and
detaineda and still holds and detains her in slavery: Wherefore
said Eliza Tyler , says she is greatly injured and hath sustained
Damages to the sum of seven hundred dollars and therefore
she sues

We command you to Summon Campbell that he be and
appear before the judge of our Circuit Court at the next July Term thereof to be
held at the city of St. Louis within and for the county of Saint on the fourth
Monday of July next then and there to answer unto Eliza Tyler a woman of color
of a plea of trespass assault and battery and false imprisonment wherefore said Eliza
Tyler says she is injured and hath sustained damage to the sum of seven hundred
dollars and have you then there this writ
