In the Circuit Court
March Term 1833
Saint Louis County, to wit; William Hanna Administrator
of all and singular the goods and chattels, rights & credits which
were of John Hanna deceased, by Edward Bates his attorney
complains of William Sublette of a plea of trespass upon the
case upon promises. For that whereas heretofore, to wit; on
the First day of January in the year of our Lord one
thousand eight hundred and twenty nine, at the County
aforesaid in Consideration that the Said John Hanna,
then being in Full life, had then and there at the request of
the Said Sublette undertaken and promised to enter into the
service of the said Sublette , and to serve him in his trade
and business in the Indian Country for the term of
eighteen months, he the said Sublette undertook and Then
and there Faithfully promised to pay him the said Hanna
the sum of three hundred dollars. And the said plaintiff
avers that the said Hanna in his lifetime (who is now
dead)
did enter into the Service of the said Sublette and
Serve him in his trade and business aforesaid, for the term
of eighteen months according to his aforesaid undertaking,
yet the said Sublette did not nor would not pay the said
Sum of three hundred dollars either to the said Hanna
in his lifetime, or to the plaintiff administrator as
aforesaid since the said Hanna's death.
And also for that whereas heretofore, to wit; on
the first day of July in the year one thousand eight
hundred and twenty nine at the County aforesaid in the
lifetime of the Said Hannain Consideration that the
Said Sublette was then and there indebted to the Said
Hanna in a large Sum of money, to wit; the Sum of
five hundred dollars for the work & labor care & diligence
of the Said Hanna by him before that time done & performed
for the said Sublette and at his request, he, the said Sublette
undertook and then and there faithfully promised the said
Hanna to pay him the said last mentioned Sum of money
whenever he should be thereunto afterwards requested. Yet
the said Sublette has not paid the last mentioned sum of
money, either to the said Hanna in his lifetime, or to the
said plaintiff the administrator since the said Hanna's death.
And also for that whereas heretofore, to wit; in The
lifetime of the said Hanna, to wit; on the first day of July in The
year one thousand eight hundred and twenty nine, at the County
aforesaid, the said William Sublette accounted with the said
Hanna of and concerning divers sums of money before that time
due and owing from the said Sublette to the said Hanna, and
then in arrear & unpaid and upon that accountaing the said
Sublette was found to be in arrear to the said Hanna in a
large sum of money, to wit; one thousand dollars and being
so found to be in arrear, he the said Sublette in Consideration
thereof, undertook and then and there faithfully promised the
said Hanna to pay him the said last mentioned sum of
money whenever he the said Sublette should be thereunto
afterwards requested: Yet the said Sublette allthough often
requested, has not as yet paid the last mentioned sum of
money or any part thereof either to the said John Hanna in
his lifetime, or to the said administration the plaintiff Since the
said Hanna's death, but the same and every part thereof
still remains due and impaid.
Wherefore the said plaintiff saith that he is injured and
hath sustained damage to the value of one thousand dollars and
therefore he sues & .
And the said William Hanna brings into Court here the
letters of administration to him granted in due form of law, of all and
Singular the goods & chattels rights and credits which were of the said
John Hanna deceased, which bear sufficient evidence that he is such
administrator as aforesaid

And the said William Sublette
1 by Geyer his attorney comes and defends the wrong &
injury when &C and says that the said plaintiff
ought not to have a maintance his aforesaid action
thereof against him- the defendant, because he says
that he the said plaintiff is not nor ever hath
been administrator of the goods & or chattels rights or
credits which were of the said John Hanna deceased
in manner and form as the said plaintiff hath
above thereof in his said declaration alleged and
this the said defendant prays may be enquired of
by the county &C
And for further plea in this behalf the said
defendant says that he did not undertake &
promise in manner and form as the said plaintiff
hath above thereof in the said several counts of
his declaration or either of them, alleged and of
this he puts himself upon the county &C
And for further plea in this behalf the said
defendant says that the said plaintiff ought not
to have or maintain his aforesaid action thereof
against him because he says, that the said
John Hanna deceased before and at the time of
his death was and the said plaintiff administrator
as aforesaid, since the decease of the said John before
and at the time of the commencement of this suit
was indebted to the said defendant, in a large
sum of money to wit in the sum of two thousand
dollars for money by the defendant lent and ad
vanced & out & expended for the said
John in his life time and at his request, and
for money by the said John in his life time had
and received to the case of the defendant, and
also on the further sum of two thousand dollars for
divers goods wares & merchandizes sold and delivered
to, and for meal drink clothing washing & lodging found &
provided for the said John on his life time by the
plaintiff and at his like special instance & request
which said several sums of money due and
owns to the defendant and together exceed the damages
sustained by the plaintiff, by reason of the non
performance of the several supposed promises &
undertakings in the declaration mentioned, and the
said defendant is ready and willing and hereby
offers to sett off and allow to the said plaintiff the
full amount of said damages according to the
form of the statute in such case made & provided
to wit at the county aforesaid and this the defendant is ready to verify and
prays judgment &C

that setting aside all manner of excuse and delay, they be and appear in proper
person before the Judge of our Circuit Court , on the 31st

testify and the truth to say in a certain matter of controversy now pending in

is plaintiff and William Sublette
