William H. Pepper by Darby his
attorney complains of Isaac White , brings of a plea
that he under into him the said plaintiff, the sum of
one hundred twenty five dollars, with interest thereon at
the rate of six per centum per annum from the 4th day
of January 1818 until paid, which to him he owes
and from him unjustly detains. For that whereas, the
said plaintiff William H. Pepper heretofore, to wit, on
saturday the Twenty - third day of May in the year
of our Lord eighteen hundred and eighteen, before the
Honorable Adam Beatty Judge of the Mason Circuit
Court, at the court house in the Town of Washington ,
County of Mason and Commonwealth of Kentucky
by the Consideration and Judgement of the said
Court, recovered against the said defendant Isaac
White , a Certain debt of one hundred and twenty five
dollars with interest thereon at the rate of six
centum peramum from the 4th day of January 1818, until
paid; and also his costs and charges by him about
his suit in that behalf expanded, which in and by
the said Court, then and there adjudged
to the said William H . Pepper for his damages
which he had sustained, as well by reason of the
detention of the said debt, as for his costs and charges
by him about suit in that behalf expended,
whereof the said Isaac white was convicted, as
by the record and proceedings thereof remain-

ing in the said Court a true Copy of Which, or
full and complete transcript of the papers and proceed-
ings in the said suit, wherein the judgement aforesaid
was rendered, as certified by the Clerk of said Court
under the seal of the said Court, and which is now
to the Court hour shown more fully appears;
which said Judgement still remains in full force
and effect, not reversed, satisfied or otherwise
vacated and the said William H. Pepper
hath not obtained, any satisfaction of or upon said
Judgement, so recovered as aforesaid; whereby an action
hath accrued to the said William H. Pepper to
demand and have of and from the said Isaac
White , the sum of one hundred and twenty five
dollars with interest thereon at the rate of Six per
centum per annum, from the fourth day of January
1818 until paid : Yet the said Isaac White (although
often requested lo to do) hath not yet paid the said
sum of one hundred and twenty - five dollars, with
interest thereon at the rate of Six per centum per
annum from the 4th day of January 1818. until paid
above demanded, the said William H .
Pepper But he to do this hath hitherto wholly refused
and still doth refuse. To the damage
of the said William H. Pepper of eighty - five
dollars, and therefore he brings suit

Know all men by that presents That I, John F. Darby
of the city of St. Louis in the state of Missouri are
held and firmly bound unto Isaac White in the sum
of fifty dollars, Lawful money of the U. States , to the
payment of which, will and truly to be made I bind
my self, my heirs. executers and administrators, firmly
by these presents. I can do with my Seal. Dated at St.
Louisthis sixth day of March in the year of our
Lord eighteen hundred and Twenty nine.

The above obligation, is never the less made upon this
condition: Whereas, William H. Pepper has this day come
an action of debt, in the St. Louis Circuit Court
on a judgement heretofore reversed in the Mason Circuit
Court in the State of Kentucky . Now therefore: if the
said John F. Darby shall pay, or cause to be paid,
all costs which may accrue in the aforesaid action now
instituted in the St. Louis Circuit Court wherein the Said
Willian H. Pepper is plaintiff and the said Isaac
White is defendant, then this obligation is to become
null and void otherwise to remain in full force
and virtue: witness my hand and seal the day
and a year aforesaid -

the Judge of our Circuit court at the next term thereof to be held at the
city of St Louis within and for the County of St Louis on the fourth monday
of March instant then and there to answer unto William H. Pepper
of a plea that he render unto him the said plaintiff the sum of one
hundred twenty five Dollars with interest thereon at the rate of Six per
centum per annum from the 4th day of January 1818 until paid to the
damage of the said William H. Pepper of Eighty five dollars and have
you then there this writ

Washington. County of Mason and Commonwealth
of Kentucky , before the Honorable Adam
Beatty. Judge of the Mason Circuit Court, on
Saturday the 23rd day of May 1812

Be it remembered that heretofore, to wit:
on the 13th day to April 1818. William H. Pepper
by his attorney A. R. Depew, filed in the Clerks
office of the Mason Circuit Court, his certain
declaration of a plea of debt, against Isaac
White . in the words and figures following to wit:

Declaration

William H. Pepper complains of Isaac
White in Custody & of a plea that he render
unto him said plaintiff the sum of One
hundred and twenty five dollars, which to
him he owes and from him unjustly detains.
For that whereas the said defendant on the
4th day of January 1817, at the Circuit and
County aforesaid, by his certain writing obligations, sealed with his seal, and now to the
Court here shown, the date whereof is the day
and year last aforesaid, promised that he
said defendant, twelve months after the
date of said writing obligations. would pay to
the said plaintiff, the said sum of $ 125

Whensoever he said defendant should be there
unto afterwards requested: Nevertheless the said
defendant although after requested & hath not
as yet paid the said sum of $125. nor any part
thereof, but to pay the same, hath hitherto
wholly failed and refused, and still doth refuse & to the damage of the plaintiff $ 125
and therfore he brings his suit &C.

The note upon which the foregoing declaration
was founded is as follows to wit:

Twelve months after date, I promise to
pay William H. Pepper , the sum of One
hundred and twenty five dollars, for value
received, as witness my hand and seal this

he may be found within your bailiwick and
him safely to keep. so that you have his body
before the Judge of our Mason Circuit Court
at the Court house thereof in the town of
Washington . on the first day of the next May

Term to answer William H. Pepper of a plea
of debt one hundred and twenty five dollars-
Damage one hundred and twenty five dollars.
And have then and there this writ. Witness
Marshall Key Clerk of our said Court
at the Court house aforesaid, the 13th day of
april 1818, and in the 26th year of our
Commonwealth.

Saturday the 23rd day of May 1818.

Judgment

Came the plaintiff by his attorney and
having filed his declaration on the 13th day to
April 1818. and the original writ which issued
thereon being duly executed, the defendant
was solemnly called but came not: Therefore

it is considered by the Court, that the plaintiff
recover against the said defendant the sum
of one hundred and twenty five dollars, the
debt in the specially filed herein mentioned
with Interest thereon at the rate of six
per centum per annum from the 4th day
of January 1818. until paid: and also his
costs by him about his suit in this behalf expended.
and the said defendant in mercy.

But this judgment is to have credit for
Fifty dollars paid on the 12th day of November
1817. as per endorsement on said note.''

upon the foregoing Judgment issued the
following executions to wit:

1st Execution

``The Commonwealth of Kentucky . To the Sheriff of Mason County , Greeting: We command
your, that of the estate of Isaac White , late
of your bailiwick you cause to be made the sum
of One hundred and twenty five dollars with Interest
thereon at the rate of six per centum per annum
from the 4th day of January 1818 until paid
which William H . Pepper , lately in our Mason
Circuit Count, hath recovered against him
for debt and interest; also the sum of five
dollars, sixty three and half cents which to the
said William H . Pepper in the same Court
was adjudged for his costs in that suit expanded
whereof he is convicted, as appears to us of accordance
that your have the said debt. interest
and costs before the Judge of our said court
on the third Wednesday in July next, to render
to the said William H. Pepper of the debt
interest and costs aforesaid, and have then
there this writ. Witness, Marshall Key. Clerk
of our said Court, at the Court house in Washington ,
the 5th day of June 1818, and in

the 27th year of the Commonwealth

H. Pepper of the sum of One hundred
and twenty five dollar with Interest thereon
at the rate of six per centum per annum
from the 11th day of January 1818until paid
which the said William H. Pepper hath recovered
against him for debt and interest: also the
sum of five dollars, ninety six and half cents
which to the said W. H. Pepper in the same
Court was adjudged for his costs by him about
his suit in this behalf expanded, whereof he
is convicted as appears to us of record, and that
you have the said Isaac White , before the Judge
of our said Court, on the third wednesday
in June next to render the said William H .
Pepper and have then and there this writ.

Witness Marshall Key. Clerk of our said
Court at the Court house is the town of Washington
on the 20th day of April 1819, and in
the 27th years of the Commonwealth.

the said supposed recovery in the said declaration

alleged and this the said Isaac is ready to
verify wherefore he prays Judgment if the
said plaintiff ought further to have or maintain
his action aforesaid there of against him
