Circuits November Term A D 1828

William Clark by a his attorney complains
of Nathan Walker of a plea of trespass on the
case for that whereas hereto for to on
the first day of August on the year of our
Lord one thousand eight hundred & twenty eight
at the aforesaid the said defendants
was indebted to the said plaintiff in the sum of
one thousands Dollars Lawful money of the United
States for so much money by the said Defendants
before then had received of the said plaintiffs
at the special requests of the defendants to the case
of the plaintiff & being he said defendants
in consideration thereof afterwards to
the same day year let's the plan lasts aforesaid
then & there undertook & faithfully
promised to the said plaintiff to pay him the
the said sum of money
be there unto afterwards requested yet the said
plaintiff although after requested hath
paid to said plaintiff said sum or any parts of
but to do has refused & still
refuses to the plaintiffs Damage of one thousand
Dollars & therefore he sues

Know all men by these presents that I am
& firmly bound unto Nathan Walker & to all
others then May be in to the to costs in the above with
to pay all costs which may accrue in the above
suits & I here acknowledge myself bound
in the sum of fifty Dollars to pay or
paid all costs which shall may accrue
and suits the help my hand &

Andrew B Barker being duly sworn saith
on the parts of the plaintiff thats said plaintiff
hath a seal interesting cause of
action againsts said defendants amounting to
at hath five hundred Dollars for many of
the plaintiff which said Defendant has
had & secured to & far the use of the plaintiff
& this affiant believes said plaintiff will be
in danger of leaving his Damage unless
said Defendants shall be held to bail the
said defendant having told this affiant that he was about to leave this state
and he the said defendant not being a resident thereof
from to and subscribed before me this
second day of september 1828

A.B. Barker on the foregoing affidavit it is orderd that a capias issue and that the defendant
be held to bail in the sum of Five hundred and eighty dollars Archibald Gamble clerk

Executed this writ on Nathan Walker september 2. 1828 and for want
of bail Committed his body to prison.

We command you to take Nathan Walker if he be found within your County
and him safely keep so that you may have his body before the judge of our
Circuit Court at the next term thereof to be held at the city of St louis within
and for the County of St Louis on the fourth monday of November next then
and there to answer unto William Clark of a plea of trespass on the case
to the damage of the said plaintiff of one thousand dollars and have
you then there this writ
