Land Claim Of Meriwether Lewis
Apparently these records involve a case of conflicting confirmation to 40
arpents of land
in the prairie of St. Louis conceded by Louis St. Ange
de Bellerive and Joseph Labuxiere
in 1770 to
Antoine Riviere dit Bacanne. Meriwether Lewis made the claim before the
First Board of Land Commissioners, established after the Louisiana Purchase
to confirm
legitimate land grants made by the French and Spanish. Lewis
claimed the land as
assignee of John Baptiste Lorins , assignee of
Philippe Riviere dit Bacanne, son of
Antoine Riviere dit Bacanne, the
original owner. The board confirmed this claim but
some question arose
as to the validity of the title. In 1809,
Meriwether Lewis sold the
land to Judge William C. Carr of St. Louis ,
and the judge was left to pursue the legalities
of the claim.

of my inablity to
give him such cash for usual in

and agree for myself and my heirs to give and
secure
to him the said Morehead an equal interest undivided
one third of all
the right title and interest which

Sir:
I have examined the patent issued on the 9th
of
June last to "Merriwether Lewis
under Antoine Baccane " or " to
the legal representatives of said
Baccane alias Riviere ".
This patent recites two confirmations, one by the first board of
Commissioners in favor of Merriwether Lewis assignee and the
other by act of Congress of the 29th April 1816, in favor of Antoine
Riviere's representatives, and professes to convey the land in the
alternative, either to Merriwether Lewis or to Riviere's legal rep
resentatives. In my Judgemnt the patent has been issued er
roneously, and I will proceed to give you very briefly the reasons
upon
which that conclusion is founded.
If it be true, that both the confirmations are for the benefit
of the
same person (Merriwether Lewis ), then the person claiming
under Lewis ,
ought to be permitted to have his final document
of title, divested of
all ambiquity, and not drawn in the alternative,
so that he will always
be obliged to go into evidence behind the
patent for the purpose of
showing, that the patent really conveys
the land to him, and that it is
not void for uncertainty in desig
nating the grantee. He is
entitled to have it issued under te first
and only legal confirmation -
that to Merriwether Lewis .
If it be true that the two confirmations operate for the
benefit of
different persons, then Lewis and those claiming under
his
confirmation, are entitled by express act of Congress to a patent
according to the confirmation made by the first Board of Commissioners. The act to the 3rd. March 1807 expressly provides, "that upon a
confirmation being made by the Commissioners, a Cretificate
shall be
delivered to the party, Stating that he is entitled to a
patent
& c, and that upon the transmission of the certificate
to
the Secretary of the Treasury, the party shall be entitled
to a
patent." Sec Sec. 5.
It is true, that the act of the 29th april
1816, also provides
that patents shall issue for lands
confirmed by that act. But
I think, it Cannot be doubted, that as
Merriwether Lewis was
entitled to a patent before the act of 1816 was pasted, the right
to claim the patent,
could not be affected by that act, non
ought its form to be changed
because of Confirmation by
that act. Upon the supposition, that the two
Confirmations
enure to the benefit of different persons, there is an
express
direction by acts of Congress for the issuing of two
patents,
and it is not the fault of the land Department that there
are
two such Confirmations, or that by the direction of the
Statutes two patents are to be issued. The difficulty is not
to be
avoided by now issuing one patent in the alternative,
either to one
confirmee or the other, which, as a grant,
is void, because the grantee
is uncertain.
Whenever this patent is produced in evidence it will be
held to be void
on its own face, unless the party goes back into
the original title and
shows that Merriwether Lewis the one confirmee
is the same person
designated as Riviere's Representative the
other confirmee. The
presumption upon the document itself
as isued in the alternative, is
that the confirmees are differ
ent persons, and that the patent is
void because it professes
to grant to either one of two persons.
The object in all the laws directing patents to issue is to
pass the fee
from the government, and to consolidate the evidence
of title. So far
from the object in reference to the title being
accomplished by this
patent, the party who wishes to use it,
is entirely afloat, and must so
back through all the title
papers anterior to the patent. I judge it
however suf
ficient for me to say, that Merriwether Lewis and his
as
signess are entitled to expect from the officiers of the
government,
the document which is directed to be issued by the act of
3 march 1807, and that they are also entitled
to claim that no
ambiguity shall appear upon the face of the document
when issued.
If the commissioner of the Genl. Land office would enter into any
con
sideration of the value of the two confirmations, and be
influenced
in the made of issuing the patents by their legal value,
then there can
be no difficulty in showing that the second
confirmation, although
by act of congress, is a mere nullity.
The act of 3 march 1807 in the 3 sec. provides
that the decision
of the Commissioners, when in favor of the claimant,
shall be final
against the United States , any act of Congress to the
contrary not
withstanding. Each claimant of land was required to file
with the
Recorder and have recorded, not only the original concession
under
which he claimed, but all conveyances by which the title was
derived
to himself, and thus the title original and derivative was
before
the commissioners and was passed upon by them. When the
claim of Merriwether Lewis was confirmed by the commissioners,
the
confirmation was for his benefit, not for the benefit of any other
person. How then shall the confirmation be final against the
United
states, if any officer of the government, or the government
itself can
confer any right to the same land upon any other
person? The value of Conflicting
confirmations has been several
times considered both in the courts of
Missouri and in the Supreme
Court of the United States and it has been
Uniformly held that
the first confirmation must prevail. In Chouteau V
Eckert
2 Thousand 344 and LeBois V Brammell 4 Howard at page 464
the Supreme Court recognises the principle as generally applicable
to
confirmations, that the first passes the legal title from the
government. In this case the effect of the confirmation to Lewis
is
declared by the act of 1807 to be "final against
the United States "
Again, it is proper to observe that the Supreme Court in the
case of
Strother V Lucas had under consideration
two confirmations
precisely like those made in this case- One by the
Board of Com
missioners- the other by the act of April 1816 confirming the claims
contained in
the report of the Recorder of land titles. In that case
at page 453 of
12 Peters , the Court examines the powers of the
Recorder of land titles
in passing upon the claims which were
embraced in his report, and shows
that he had no authority
to act upon claims to land where the title had
been previously
confirmed by the commissioners. In such cases, the
court
pronounces his action "either merely cumulative and so
in
operative or if adverse, merely void as an assumption or
" of power in a case in which he
had not juris
diction and his action must be a mere nullity."
I think, sir, that the commissioner will not hesitate to
cancel this
patent, as made out in an improper form, and to
issue one to
Merriwether Lewis as is required by the act of 1807.

cinq pieds de long, dont la longueur prise quatre
fois fait juste l'arpent usite en ce
pays, qui est de cent quatre
vingt pieds sur chaque face; a
l'execution de quoi
mefaisant
accompagner proprietaire et de ses
dits deux voisins les plus
pour me servir de temoins l'aide et a
m'indiquer exactement la veritable
situation de leurs concessions respectives, je suis et l'ai fait borner
en ma presence avec des
pierres a ses quatre extremites, apres l'avoir mesuree
sur ses ligues
de largeur et longueur dont les deux premieres paralleles, c'est
a dire
de largeur vont entre le nord, quart au nord ouest et le nord, ou
plus exactement s'ecartent du nord vers l'ouest de
cinq degres et les deux autres
c'est-a-dire de longueur aussi
paralleles vont au ouest quart au nord ouest, on
mieux, s'ecartentdu ouest
vers le nord de onze degres quinze minutes sans
aucun
egard a la variation du
compas qui part y avoir, et font par consequent en
divergeant la vue et allant du point du
depart vers les rumbs indiques un angle
aign de
soixante treize degres quarante-cinq minutes, compensation
faite des differences
causes par les inegalites des terres et
inclinaisons des lignes les unes sur les autres
par rapport aux
perpendiculaires horizontales qui servent toujours a leur vraie
mesure tant sur la largeur que sur la longeur.
Ainsi je l'atteste par mon seing et par l'aveu unanime de tous les
proprietaires
susnommes assembles dans ce moment avec l'approbation de
mon dit sieur don Pedro
Piernas dans la chambre
du Gouvernement pour se servie mutuellement de temoins et
