William Clark by his attorney com
plains of Augustus H. Evans of a plea of trespass
on the case for that whereas heretofore to wit on the
first day of November in the year one thousand
eight hundred and twenty six at the County afore
said in consideration that the said William
at the special instance and request of the said
Evans would loan and advance to one John F. Lang
ham the sum of one hundred and sixty six dol
lars and sixty six and two third cents he the said
Evans then and there undertook and faithfully
promised the said William that he the said E
vans would see that the said sum of one hundred and six
ty six dollars, and sixty six and two third cents
should be returned to him (meaning said William ) on the arrival of one
Col.McRee (thereby meaning one William McRee) or
sooner if wanted. And the said William avers
that he confiding in the said promise and un
dertaking of the said Evans did afterward to wit
on the day and year aforesaid to wit at the
County aforesaid loan and advance to the said
Langham- the sum of one hundred and sixty
six dollars and although the said Col.McRee
(meaning the said William McRee) did arrive
long since to wit on the first day of August in
the year Eighteen hundred and twenty five to wit
at the County aforesaid yet the said Evans although
often requested hath not as yet paid the said sum
of one hundred and sixty six dollars or any part
thereof to the said William but the said Evans
to do the same hath hitherto wholly neglected
and refused and still doth neglect and refuse
to the damage of the said William of three
hundred dollars & therefore he sues &c
And wherefore also afterward to wit on
the day and year last aforesaid at the
County aforesaid the said Evans was in
debted to the said William in the fur
ther sum of two hundred dollars for so
much money by the said William before that
time lent and advanced to one John J.Lang
ham at the special instance and request
of the said Evans and being so indebted
he the said Evans in consideration there
of afterwards to wit on the day and year
last aforesaid at the County aforesaid
undertook and then and there faithfully
promised the said William to pay
him the said last mentioned sum of
money when he the said Evans should
be thereunto afterwards requested. Yet
the said Evans although often requested
hath not as yet paid the said last
mentioned sum of money or any part
thereof to the said William but to do the
same wholly neglects and refuses to the damage
of the said William of three hundred dollars
& therefore he sues &c.

County of St Louis Sct:To the Sheriff of St Louis County — Greeting
We command you to summon Augustus H Evans that he be and
appear before the Judge of our Circuit Court at the next Term thereof to
be held at the City of St Louis within and for the County of St Louis
on the Fourth Monday of November Instant then and there to answer
unto William Clark of a plea of trespass on the Case to the damage
of the said William of Three Hundred Dollars and have you then there
this writ.
