You will please take notice, that the said
several plaintiffs, by their agent or attorney, will
attend at the dwelling house of Elias Mitz , in
the county of St Louis 9 or 10 miles from St Louis ,
on Saturday the fifth day of August next, be
tween the hours of 10 Oclock A.M. and six Oclock
P.M. of that day, and then of there take the depo
sitions of witnesses, to be read in evidence on
the trial of the above mentioned causes, on the
part of the plaintiffs, when & where you and
the said plaintiffs will attend & cross exam
ine, if you think fit.

County of St Louis In the Circuit court July term
1825

Winetta a free girl of color held in slavery and
who is permitted by the court to sue as a poor person
by Alexander Clark her next friend who by
her attornies Edward Bates and Issac Mc GcGirkassigned
as counsel by the said court complains of
Ephraim Musick and of Charles B. Hatton of Sally his wife
Owen Wingfield of Sally his wife Isaac Voteau and
John Butter and Betsy his wife John Whitset alias Whitesides
Mitchel Hatton and Anne his wife Michael Sanford and
Theresa his wife John Whitset alias Whitesdes Jr. and Lucinda
Whitset alias Whitsides of a plea of trespassfor the
the said defendants heretofore to writ on the first day
of January in the year of our Lord eighteen hundred
and twenty five with force and arms at the county of
St Louis unlawfully an assault did make in and upon
the body of the said Winetta & then & there beat bruised
and ill treated her the said Winetta and then and
there imprisoned her the said Winetta and kept and and
detained her in prison without any reason ableor
probable cause whatsoever, and have even since kept
and detained her in prison and do still keep and
detain her in prison against the will of the said
Winetta and contrary to the laws of this state and other
wrongs to the said Winetta then & there did against the peace
of the state. Wherefore the said Winetta says she is injured has sustained
damage to the amount of five hundred dollars & therefore

attempted to be justified, saith, that she
the said Winnetta , by reason of any thing
by the said Ephraim in that plea alledged
ought not to be barred from having
and maintaining her aforesaid action
thereof against him the said Ephraim ,
because the saith, that she is not the
slave of him him the said Ephraim
but is a freeperson, and this she is
ready to verify, wherefore the said Win-
netta prays judgment, and her damages
by her sustained by reason of the
committing of the said several trespasses in her said dec-
laration mentioned, to be adjudged to her .
