You are hereby commanded to summon Isaac W White
to appear before the undersigned, one of the Justices of the Peace
within and for said county, on the third Saturday in this month at his office in
said township between the hours of ten o'clock in the fore noon,
and three o'clock in the after noon, of the said day, to answer to Mrs. Harriet Parmely
adm. of Sylvanus Parmely decd in an action of debt

We, the undersigned, Isaac W White and George Morton
acknowledge ourselves to be indebted to Harriet Parmely administrator of
Sylvanus Parmely decd in the sum of one hundred & fifty Dollars,
to be levied of our respective goods and chattels, lands and tenements; upon condition, neverthelss, that whereas,
the said Isaac W White
hath appealed from the judgment of Jos. c Brown a Justice of the Peace within the City
of St. Louis , in a certain action, wherein the said Harriet Parmely administrator
as aforesaid is plaintiff and the said Isaac W
White is defendant
Now, if the said Isaac W White
the appellant, shall prosecute his said appeal with effect, pay and satisfy the condemnation money, and all costs, or otherwise abide the judgment of the Circuit Court , in said appeal, then this recognizance to be void, otherwise to remain in full force and virtue.

In the day of the writ in this case
by the constable the same is by him witnessedexecuted
and the parties appear, the plaintiff, by her
and the defendant in person and neither of the
require a jury but Submit their matters in
dispute with the evidence touching the same to the justice who after due deliberation had therefore doth
find the defendant indebted to the plaintiff in the
sum of Seventy five dollars for her debt and that the plaintiff has sustained damages by rea-
son of the detention of the said debt to the
amount of twenty six dollars and twenty five
cents of, which damages the justice finds the
dollars have been paid by the defendant having
of said damages a balance of sixteen dollars
and twenty five cents still due and payable to the
plaintiff, therefore it is considered by the jus
tice that the plaintiff recover of the defendant the
said debt and balance of damages, together with her costs on
this case laid out and and that she have
thereof execution —
In this case the defendant asks an appeal from the
of the justice and files his recognizance therefore on the day
appeal granted,

pending in our said Court, wherein S.Parmely's Ads is plaintiff
and Isaac W White is defendant on the
part of the Defendant; and have you then there this writ,
