Antoine Cetoleau, plaintiff by his attorney,
complains of Joseph Rebedeau, in a plea of trespass,
on the case for that whereas the said Joseph the defendant
on the first day of June, eighteen hundred and
eighteen at, the county of St , Louis aforesaid, and within
the jurisdiction, of this court was indebted to the plaintiff
of, the sum of one hundred fifty, dollars for the work
and labour, case & diligence, of him, the said plaintiff
before that time done & bestowed, in about the business,
of him the said defendant & at, his special,
instance & request, so indebted in consedera-
tion thereof then &, there undertook, & saith
fully promised the plaintiff to pay him the said
sum of money on request.

And also for that whereas the said defendant
on or about the first day of May, eighteen hundred and
eighteen the panis nation or tribe of Indians to wit,
at the county of St , Louis aforesaid and within, the jurisdiction,
of this court, being possessed, of certain goods,
wares & merchandizes, did offer and profess, to him
the said plaintiff &, promise that if, he the, said
plaintiff would receive, said goods wares, and
merchandizes & trade, them for him said defendant to and with the said
Panis Indians, that he the said Joseph would pay him
therefore, the sum of one hundred dollars, and the said
plaintiff that he did on his part, then &, there agree
to receive & take said, goods of the defendant and
trade them for him and that in pursuance, of said
agreement, he said plaintiff did also then & there
secure, said goods of the defendant and did barter,
& trade them to the said Indians for the benefit and & use, of said defendant by reason, whereof the said
defendant become liable to pay to him the plaintiff
the

plaintiff the aforesaid, sum of one hundred dollars and
being so liable inconsideration thereof then & there under
took &, faithfully promised to pay the plaintiff the
said sum, of money on request.

And also for that wheras the said Antoine Cetoleau,
being an Indian trader and the said Joseph the defen,-
dant on the said day & year last aforesaid at the
place and within the jurisdiction aforesaid,, being
the owner and possessor of certain goods & other articles
suitable & proper, for the trade, with the Indians,
did then & there engage & employ him the said plaintiff
to trade said goods & other, articles to an with the indians
for the benefit, of him the said defendant and prom-
ised & agreed to pay him the said Antoine
of one hundred dollers, and the said
Antoine in fact, says tht he did trade traffic & barter,
said goods & other articles to & with, the indians for the
use & benefit, of him, the defendant - by reason whereof
he the said defendant, there & there became liable
to pay him the said Antoine , the said last, men-
tioned sum, of one hundred dollars whenever
after wards he should be thereunto requested and
being so liable in consideration therof, then and
there undertook and faithfully promised to pay
the plaintiff the said last mentioned, sum of
one hundred dollars on demand.

And the for that whereas the said
defendant on the day of year last aforesaid, at the
place, & within the jurisdiction, of the court being
possessed of certain other goods and articles necessary,
& proper for the Indian tade, and the said Antoine
being then & there an Indian trader, he the said defendant,
did engage, the said Antoine to trade, said
goods and other articles with the Panis , Indians
for the profit and benefit of him the said Joseph
and promised & agreed, that if he would do,
the best, he could with said goods and make
the greatest, profit in his power out, of them for,

him said Joseph , that he would pay him the said
Antoine therefor out of the profits resulting from the
trade & barter of said goods the sum of one huedred
dollars lawful money of the United States And
the said Antoine avows that in pursuance of said
agreement on his part he received said goods and
did the best he could with them and made the
greatest profit in his power for the defendant by
trading them with the the said Panis Indians, and
that great profits to wit five hundred
dollars were made to the said Jospeh from
the trading of said goods & articles aforesaid by
the said Antoine . by reason whereof the said
Joseph became liable to pay the said Antoine the aforesaid sum of one hundred dollars whenever he should be thereunto requested and being so liable in consideration
thereof then & there undertook & faithfully promised the
plaintiff to pay to him the said last mentioned sum, of money on request,.

And also for that whereas the said, Joseph on the
said first day of June eighteen hundred, & eighteen at
the county of St Louis aforesaid was indebted to the said
Antoine in one other sum of one hundred dollars law
ful money of the United States , for other the work and
labour case & dilligence of him the said Antoine as
an Indian, trader, done given performed and be
stowed in about the trading & trafficking, of certain
goods wares & merchandizes, of him the said Joseph
to and with the Panis Indians, for the use and benefit, of him the said Joseph , before that time & at,
his special instance & request and being so indebted
in consderation thereof then & there undertook, and
faithfully promised, the plaintiff to pay him the said
last mentioned sum of money whenever he the defen
ant, should be thereunto requested.

Nevertheless, the said Joseph tho often requested, hath
not paid to him the said Antoine the aforesaid sum of
one hundred dollars; but the same to him to pay

hath hereunto wholy refused, and still doth, refuse, to
his damage two, hundred dollars, and therefore he
sues, by

that he, be and appear before, the Judge, of our Circuit
Court at the next term, to be held at the, town of St Louis

unto Antoine Cetoleau of a plea of trespass, on the case, to
the, damage of said plaintiff, two hundred dollars
and have, you then there, this writ,

as the said plaintiff hath above, thereof complained,

the Said several sums, of money in his declaration mentioned, and this he is ready,
