St Louis county vs Luis Beaudain Plaintiff
in this suit
complain of John Plabbou
& Antoine Merchants and
cabbane in
trade, drafting in merchandize under the name style & firm of Cabbane &, of a plea of trespass
on the loar- for that whereas
the
said Plaintiff to wit on the twenty
fifth
day of August in the year of our
Lord one thousand eight
hundred & fifteen at St Louis in the county
St Louis
& within the jurisdiction of
this court, at
the special appointment
and request of the said Defendants
had
agreed to enter into their service
&
employment as a trader and had
agreed to go up the Missouri
river and
its dependencies to trade with the Indians
for the said Defendants as their agent- and
to continue in such their
service & employment untill the first
day of June thereafter - the said
Defendants
in consideration thereof promised to
pay to the said
Plaintiff therefor three
hundred dollars at the expiration
of the
said term of service-
And the said Plaintiff says that
afterward,
to wit on the same day & year aforesaid,
in permanance of this said
agreement
he intend into the service & employment
of the said
Defendants as such trader and proceeded up the Missouri river
& its dependencies - and carried on
trade
& merchandizing the said Defendants
among the Indians
there, according to
the directions & instructions of the said
Defendants and continued in their
service as such trader, - performing all the
duties incumbent upon him
to do and
perform as such trader under the said
agreement, untill
the first day of June
one thousand eight
hundred & sixteen
and untill his term of service was completely
expired &ended- yet the said
Defendants
although often requested
have not paid to the said Plaintiff
the
said sum of three hundred dollars or
any part thereof- but to
pay the same have hitherto wholly refused
& still do
refuse to the great damage of the said
Plaintiff
And for that whereas the said Defendants
afterwards to wit on the first day of
July one thousand eight hundred & seven
teen
at the place & within the jurisdiction
aforesaid were indebted to the said plaintiff in
the further
sum of four hundred dollars
for the work & labor care & dilligence of the
said plaintiff, before that time done && performed
by the said
Plaintiff in and
about the business of
the said Defendants
as this servant or
agent in a trading voyage
up the Missouri River & its dependencies
among the
Indians and at the special instance
& request of the said
Defendents
And being so indebted, they the said Defendants
in
consideration thereof afterwards to wit
on
the same day & year last aforesaid at the
place & within the jurisdiction
aforesaid undertook
& faithfully & to pay
said Plaintiff the said last mentioned
sum of money when they should be there-
unto afterwards requested.
And whereas also the said Defendants, afterwards,
to wit,
on the same day & year last
aforesaid at the place & within the
jurisdiction
aforesaid in consideration,
that the said Plaintiff
at the like
special intance & request of the
said Defendants had before that time
done
Informed of other his work
& labor
care & dilligence in & about the business of
the said Defendants as their servant or
agent
in a trading voyage up the Missouri river
& its dependencies
among the Indians and
in them carrying on trade & merchandizing for
them. They the said Defendant, undertook and
then & there faithfully promised
the said Plain-
tiff to pay him so much money as he
there
for reasonably deserved to have for
the
same. When they the said Defendants should
be thereunto afterwards requested. And the said Plaintiff avers that he themfore reasonably
deserved to have of the
said Defendants
the further sum of four hundred dollars
to wit at
the place & within the jurisdiction
aforesaid whereof the said Defendants afterwards
to wit on the same day
& year
last aforesaid there had another - Yet the
said Defendants
although after requested&
have not paid to the said
Plaintiff the said
several sums of
money above
or any part themof,
but to pay the same
have hitherto wholly
refrained & still do
to the damage of the said
Plaintiff
of six hundred dollars and thereof

Be it remembered that on the twenty fourth
day of July, in the forty four
year of the independence of
the United States of America , (A. D. 1819.)
before
me Francis M. Guyol, one of the justices of the peace within and for the
county of St.
Louis aforesaid, personally appeared Alexis Loise , who being
sworn on the Holy Evangelists, (by virtue of a dedimus notice and rule
dated the nineteenth day of July 1819) Deposedeth and
sayth, that some time about three or four
years ago, Louis Bodouin was
engaged on
a voyage or wintering trade () for
Chemié and Cabané
and started from St. Louis to pursue his voyage in a boat wherein the
defendant was also engaged as a hand, that said
Louis Boudain was as acknowledged
the bourgeois or trading clerck of Cabané
and Chemie, and that when
getting to cotes , said Bodouin then begun drinking
and
continued so drinking until he had no more liguor: that when
theygot
to the wintering ground the said
Bodouin being sometimes drunk was not able
to
trade with the Indians when they came for
that purpose.
Question by the defendant. When Louis Bodouin was drunk and the
Indians came to trade, and when this
L. Bodouin's brother demanded
him
the of the store to trade with these
Indians Did he not refuse to give it?
Answer: yes he did so.
Question: When the a , came to trade was then Louis Bodouin drunk?
Answer: Yes, he was a little intoxicated.
Question: Was he then able to trade with the Indians?
Answer: He said to the that if they would come and
trade with them all their he would give them a little keg
of
one gallon of wisky; the indians brought in their and
Bodouin being drunk took these and threw them out;
and the indians and drew his pistol upon them, after
having much disputes with them.
After having pushed the
indians and pulling out, they demanded of him the keg he had promised to
gave
them, Louis Bodouin refused to
give it, saying he had not the
. The said Bodouin had been drinking with the indians.
The indians
took their pettries, and went to trade them with Charles
.
Question: To the best of your knowledge how many packs us as there
at the time you left the
trading ground of the to go and trade with
the pawnes.
Answer: there was ten packs of deerskins, three of racoons and one of beaver.
Question: At the time Bodouin
was drinking and
with the
indians did they breake the door of the store and
pillage it?
Answer: Yes.
Question: Out of the fiveteen packs that were in the store
how many did Louis Bodouin trade himself
answer: Louis Bodouin traded
a small part of these
and his brother traded all the rest. and the
witness stated
that Louis Bodouin , made
no other voyage for Cabané and
Cherié but the one aforesaid.
Question by planitifs attoney: do you know how long, Louis
Bodouin
remained in the employment of Cherié and
Cabané?
Answer: eight or nine months.
Question: Among what nations did you go with Louis Bodouin
to trade?
Answer: I went with Louis Bodouin to the , but did not
go with him to the .
Question: Where did you trade with the Ayowais?
Answer: at the Otos trading ground.
Question: Why did Louis Bodouin throw out the of
the indians?
Answer: he does not know, because he did not understand
Question: Whos there much trading done?
Answer: Very little.
Question: did many indians come to trade with you?.
Answer: When the indians came from abroad, they came to trade and traded when they could.
Question: do you know of any pethies buy carried away from the trading ground by the indians?.
Answer: They carried then back whenever the came to trade and Louis Bodouin being drunk would not trade with them..
Question: Was Louis Bodouin always drunk during the voyage or wintering?.
Answer: yes, but some times he was in his good=senses then he traded with the indians.
Question: Daveprocured great many pettris for the company that reason?
Answer: No, we did but very little.
Question: did you return to St. Louis with Bodouin ?.
Answer: Yes. And further this deponent sayth not.

sworn deponeth
and sayth that he
saw Louis Bodouin who was in throw an
indian
out of the door with his pettries; the indian told the deponent
to take
the petries, so he did, and carried them
away. Then —
Charles Sauguiret traded for that pettry, the deponent was
one of the
of Charles Sauguinet. The deponent further sayth
he saw Louis Bodouin often times intoxicated, but as he was not
this
deponents he did not take much notice of his
conduct. This was at the wintering ground of the Otos..
deponent also sayth he understood D. Bodouin was in the
employ=ment
of Cabané and Chemié at that time and further this
deponent
sayth not.
