In the St.Louis Circuit Court
to October term 1818.

Francois Leclerc by his attorney complains
of Joseph Robideau of a plea of trespass on
the case, for that whereas, the said Joseph heretofore
to with, on the first day of July in the year one
thousand eight hundred and eighteen at the county
aforesaid was indebted to the said Francois in the
sum of four hundred dollars lawful money of the
United States for buffaloe and beaver
fur, beaver traps, blankets, calico, looking
glasses, canoe, tent, leather, coarse linen, and
bacon, to the said Joseph by the said Francois before that time sold and delivered, and at his
special interest and request; and being so
thereof and he the said Joseph in consideration
thereof, after ends, to wit, on the day
and year last aforesaid at the county aforesaid
undertook and then and there faithfully
promised the said Francois to pay him
the said cast mentioned sum of money when
he the said Joseph should be thought afterwards requested.

and also for that whereas, afterwards, to
with, on the day and year last aforesaid, at
the county afousaid, in consideration that the
said Francois Leclerc at the like special
instance and request of the said Jospeh had
before that time sold and delivered to him the
said Joseph certain large quantities of goods,
wares and merchandizes, , furs
provisions, he the said Joseph undertook &
then and there faithfully promised the said
Francois to pay him so much money as he
therefore reasonably deserved to have of the
said Joseph when he the said Joseph should
be afterwards requested. And the
said Francois avers that he therefore reason
ably deserved to have of the said Joseph the
further sum of four hundred dollars, whereof
the said Joseph afterwards, to with, on the
day and year last aforesaid at the county
aforesaid had noticed.

And whereas also, the said Joseph afterw
ards, to with, on the day and year last afore
said in the county aforesaid was indebted
to the said Francois in the further sum of four
hundred dollars for the work and labor, care and diligence of the said Francois by him the
the said Francois before that time , transformed and bestowed, in and about the business of
the said Joseph in carrying on trade and
commerce for the said Joseph with the Paris Indians in the nation of the Paris , to wit,
at St. Louis aforesaid, and at his special interest and request:----- And also in the
like further sum of four hundred dollars for goods, wares and merchandizes, by the said Francois before that time sold and delivered to the said Joseph and at his like special instance and request: And also in the further sum of four hundred dollars by the said Francois before that
time lent and advanced to, and paid, laid
out and expended for the said Joseph and
at his like special instance and request:
And also in the further sum of four hundred
dollars for other money by the said Joseph
before that time had and occured to and
for the use of the said Francois : and
being so indebted he the said Joseph in
consideration therof afterwards, to wit, on
the day and year last aforesaid, at St .
Louis aforesaid, undertook and then and
there faithfully promised the said Francois
to pay him the said several sums of
money in this recent mentioned when he
the said Joseph should be thinkto afterwards
requested.

Nevertheless the said Joseph
not regarding his said several promises
and under takings, but continuing and
frandulently intending, craftily and subtly
to deceive and defaced the said Francois

hath not as yet paid the said several
sums of money, or any or of them, or
any part thereof to the saidFranois
although often requested so to do. But
the said Joseph to pay him the same
hath hitherto wholly neglected and refused,
and still doth negelect and refuse: to the
damage of the said Francois of one
thousand dollars; and therefore he brings
suit, .

personally came and appeared Francois Leclerc
, and made oath that there is a
real debt due and owing from
Joseph Robideau to him ammounting to the
sum of two hundred & seventy two dollars for the recovery
of which he now brings suit; and that
he believes the said Joseph Robideau
ought to be held to bail in the sum
of three hundred & fifty dollars to secure the said
debt, interest and costs.

you, in the case depending in the St. Louis circuit court, where
in I am planitiff and you are defendent, and where you may

Whereas I, Francis M. Guyol, a justice of the peace within
and for the said county, have received a Dedimusissuing out of the
circuit court of the county of St . Louis aforesaid, and under the seal
of said court, directed to any judge, or justice of the peace in said-
County, for the examination of witnesses in a certain cause there depending,
between Francis Leclerk plantiff and Joseph Robedoux defendant;-
and whereas I am informed that Lilvertre Pratte and Charles-
LaBerge of this county are material witnesses for the planitiff.-
There are therefore to require you to summon the saidLilvertre
Pratte and Charles Charles LaBerge, that they and each of
them severally and personally, be and appear before me at my
office in the town of St . Louis , county, and township of St . Louis ,
on the twenty fifth day of this month instant between the hours of 9 in the morning and 6 in the evening then and there
to be examined and testify the truth according to the best of their
knowledge, for and on behalf of said planitiff. Thereof they,

Depositions of witnesses, produced, sworn and examined
on the twenty fifth day of June, in the year of our lord eighteen
hundred and nineteen, between the hours of nine of the clock in
the forenoon and six of the clock in the afternoon, of that day
at the house and office of F. U. Guyol, in the town of St. Louis
in the county of St. Louis in the territory, before me F. U. Guyol
a justice of the peace in said county, by virtue of a dedimus for
the examination of a witnesses, in a certain cause now depending
in the circuit court of the aforesaid county of St. Louis between
Francois Leclerck and Joseph Robidoux , and wherein said Francois
Leclerk is plaintiff against said Joseph Robidoux , said depositions
taken on behalf and on the part of said plaintiff, and said dedimus
directed to any judge, or justice of the peace within the county of
St Louis aforesaid

Charles LaBerge of lawful age being produced
Sworn and examined on the part of the plaintiff, deposeth and sayth
that sometime in July of the year eighteen hundred and sixteen
he formed a partnership with, Citoleux alias Laugerin, Abram LeDoux and Antoine LeDoux, in which they all paid
their share; that after having bought all the goods, wares,
merchandise and other articles, necessary for their trade; the
said deponent furnished them with several articles amounting to One hundred dollars and gave them also fifty dollars in money; upon which said
advance each of the four members of the company were indebted
to him for one fourth of said sum; the deponent also sayth
that he remained in St. Louis , instead of going to trade in the Missouri , as he had first the intention, and sold to Francois
LeClerk all his interests in said firm and received of said Leclerk
a full and satisfactory compensation for the name, and at the
risks and perils of the said LeClerk, without any recourse
against him, said deponent. And furthermore Deponentsayth not.

Joseph Robidoux said that he was satisfied of Mr Leclerc
and Laugerin Citoleux and that he would pay to each of them
the sum of one hundred dollars, for their sevices rendered
him in the trade with the and furthermore, deponent sayth not.
