In the court of Common pleas of the Dis-
trict of Saint Louis of the term of July
one thousand eight hundred and eleven

St Louis District Ss Frederick Kalor com-
plains of Alexander Willard of a plea
that the said Alexander the defendant ren-
der unto him the said Frederick the plain-
tiff the sum of one hundred and ten dollars
which he owes to him the said plaintiff and
from him unjustly detains for that the
said defendant on the twenty thirdy day
of May in the year one thousand eight
hundred and ten at the town of St Louis
in the District of St Louis and within the
jurisdiction of this court made his cer-
tain instrument in writing under his hand
and seal of that date and which is read
here to the court shown and thereby twenty
days after date promised to pay or cause to be
paid into one John
the full sum of one hundred and ten dol-
lars for value received of him and there
then delivered the said in
writing to signed and sealed as aforesaid
to the said John Donahue and the said
John Donahue here afterwards, and before
the payment of said sum of money men
tioned in the said instrument of consisting
of any part thereof to wit on the fifth
day of June in the year of one thousand
eight hundred and eleven at the place
adn within the jurisdiction aforesaid assigned the said instrument in writing the and
hand of the said John Donahue being on the
back of the same instrument in writing
under seal set and subscribed by him and
by that assignment the said John Donahue
according to the statute in such case made
and provided ordered and assigned the contents
of the paid instrument in writing and the
money mentioned in the same to be paid
to the said plaintiff and then and there de-
livered the same instrument in writing to assigned a aforesaid to the said plaintiff
of all which premises the said defendant after-
wards to writ on the same day and year last
aforesaid at the place and within the juris-
diction aforesaid had notice whereby an action
has to the said plaintiff to have de-
and of the said defendant
the sum of money mentioned in the said
instrument of writing according to the
times of the same and of the said assign-
ment to made thereon as aforesaid-

Yet the said defendant although of-
ten requested the said sum of money in
the said instrument of writing mentioned
any part thereof to the said plaintiff
has not yet paid but the the same
part thereof to pay the said defendant
has wholly refused and still re-
fuses to the said plaintiff his damage of
two hundred and fifty dollars and there

fore he brings suit by

We command you to take Alexander Willard
If he may he found in your bailiwick and him
safely keep so that you have his before the Judges
of our court of common pleas to be holden at the
town of St Louis within and for the District of St Louis
on the first monday of July next then there to Answer
unto Frederick Kalor in a plea of Debt one hundred
and ten dollars. To the Damage of the said Frederick
the sum of two hundred and fifty dollars and
have you then there this writ.

Know all men by these presents, That we Alexander Willard and John are held and firmly
bound unto Alexander M'Nair, sheriff of the District of St. Louis , his assigns or successor in office,
in the sum of two hundred & fifty Dollars
currency of the United States , to which payment well and truly to be made, we bind ourselves and
each of us by himself, our and each of our heirs, executors, administrators and assigns, firmly by
these presents. Sealed with our seals and dated this fourteenth day of
June in the year of our Lord, one thousand eight hundred and Eleven The Condition of the above obligation is such, That if the above
bound Alexander Willard
shall appear at the next court of common pleas to be held at the
town of St. Louis on the first monday in July
next to answer unto Frederick Kalor
in a plea of Debt
to his damage as it is said two hundred
and fifty dollars and is judgment be given against him
at that or any subsequent term of said court, that the said Alexander Willard
will pay the Damages aforesaid and
costs, or that the said John Haff and James Haff
will do it for him: then the above obligation to be void, else to remain in full force and virtue
in law.
