In the Court of Common pleas in the District of St Louis
of the term of November in the year of our Lord
One Thousand Eight Hundred and ten.
St Louis District Ss. Paul Primeay complains
of Louis Labeaume for that the said Louis on the
twenty seventh day of August in the year of our Lord
One Thousand Eight Hundred and Ten at St Louis
in the district of St Louis and within the jurisdiction
of their court, was indebted to the said Paul in One
Hundred and fifty dollars, according to the account
hereuntoannexed for the work and labor Care and
diligence of the said Paul by him the said Paul before
that time done performed and bestowed in and about
the business of the said Louis and for him and at his
instance and request, he the said Louis in conside-
ration thereof afterwards, to wit- on the same
day and year at the places and within the juris
diction aforesaid, undertook and then and there
faithfully promised, the said Paul to pay him the
said mentioned sum of money, when he should
be thereto afterwards requested, and whereas
afterwards, to wit-on the same day and year
aforesaid at the place and within the jurisdiction
aforesaid in consideration that the said Paul at the
like instance and request of the said Louis, had before
that time, done, performed and bestowed other his
work and Labour, care and diligence in and about
other the business of the said Louis, according to the
account hereunto annexed, he then and there un
dertook and faithfully promised the said Paul to
pay him so much money as he therefore reasonably
deserved to have, when he planed be there to after
wards requested, and the said Paul avers that
he therefore reasonably deserved to have of the
said Louis other one Hundred and fifty dollars, to wit
at the place and within the jurisdiction aforesaid
whereof the said Louis, afterwards to wit on the day
and year last aforesaid there had . and
whereas the said Louis on the day and year afore-
said, and at the place and within the jurisdiction
last aforesaid, was indebted to the said Paul in
another sum of one hundred and fifty dollars
for divers goods, wares and merchandise, by the
said Paul before that time sold and delivered
to the said Louis, at his special Instance and
Request and being so indebted, he the said Louis
in consideration, thereof afterwards to wit
on the day and year aforesaid, at the place afore-
said and within the jurisdiction last afore
said, undertook and then and there faithfully
promised the said Paul to pay him the said sum
of money, when he should be therto afterward
requested and whereas afterward, to wit on
the same day and year aforesaid at the place
aforesaid and within the jurisdiction last aforesaid
in consideration, that the said Paul at the like
request of said Louis, had before that time
sold and delivered to the said Louis divers other
goods, wares and merchandise, he the said Louis
undertook and then and there faithfully pro-
mised the said Paul to pay him so much money
as he therefore reasonably deserved to have
which he the said Louis should do thereto after
wards requested. And the said Paul avers that
he therefore reasonably deserved to have of the
said Louis other One Hundred and fifty dollars
of like Lawfull money to wit, at the place last
aforesaid and within the jurisdiction last aforesaid
whereof the said Louis afterward, to wit on the same
day and year aforesaid there had notice
and whereas the said Louis to wit
on the same day and year at the place and within
the Jurisdiction last aforesaid was indebted to the
said Paul in the sum of One Hundred and fifty
dollars for money by the said plaintiff before
that time paid, laid out and expended for the
said Louis at his special instance and Request
and for other money before that time had and re-
ceived by the said Louis to the use of the said
Paul before then lent and advanced to the said
Louis at his like instance and Request, and being so indebted, the said Louis in Conside-
ration thereof afterwards to wit, on the same
day and year and at the place and within the
Jurisdiction last aforesaid, undertook and
then and there faithfully promised the said
Paul to pay said sum of money last mentioned
when he should be the afterwards thereto requested
yet the said Louis although after requested
has not paid the said sums of money or any
part thereof to the said Paul , but has hither
to wholly refused and still refuses to the said Paul
his damages of Two hundred Dollars and there
fore he brings suit &c

We command you to summons Louis Labeaume
if he may be found within your bailiwick that he be and
appear before the judges of our court of common pleas
to be holden at the town of Saint Louis in and for the district of
Saint Louis on the first Monday of November next
then there to answer unto Paul Primeau of a plea of
trespass on the case to the damage of the said Paul Primeau
the sum of one hundred and fifty dollars and have you then there this writ.
