going declaration named is jointly and on to
him said Powell plaintiff in same in the
sum of four hundred and fifty dollars-
and that the affiant doth verily
that said La Marche is not a residant
of or resding within the state of Mis-

by J. Spalding his attorney complains of
Antoine La Marche of a plea of trespass
on the upon promises for that
said defendant heretofore to act on the first
day of April in the year of our Lord eigh-
teen hundred thirty five at said was indebted unto said
plaintiff in the sum of a thousand dollars
for good awards & by
said plaintiff before the sold and delivered
to the defendant at his special instance &
request and for money by said defendant be-
fore the to the care of the
plaintiff. & for other money by the plain-
tiff before advanced to the
said defendant & paid out for him on this
spacial instance & request and being so
indebted the defendant in consideration
thereof afterward to amt on said day &
year & at said place undertook then
& there promised the plaintiff to pay his
said sum of money when he should
be thereto afterwards requested.

Nevertheless the said defendant although
after requested to do not paid said
sum of money or any part of it but has
referrd to the damage of the plain
tiff of a thousand dollars & therefore
he sued & G

We command you to Attach Antonie La Marche
by all and singular his lands and tenements,
goods, chattels, moneys, credits, and effects, or so much thereof as shall be
sufficient to secure the sum of Four Hundred and fifty dollars
with interest and costs of suit, in whose
hands or possession soever the same be found, in your bailiwick, that the said
Antonie La Marche
be and appear at the next term of the Circuit Court , before the Judge thereof,
on the first day of said term, to be holden at the city of St Louis , within
and for the county of St. Louis , on the Fourth Monday of July next
then and there to answer unto Ludwell E Powell
of a plea of on the case upon promises
to the damage of said plaintiff of a thousand
dollars: And also that you might summon all and every person, in whose
hands or possession soever, any such lands, tenements, goods, chattels, mo-
neys, credits or effects may be found, and particularly Pierre Chouteau Jr
and the American Fur Company that they be and appear
before the judge of our said court, on the first day of the term aforesaid,
then and there to answer unto what may be objected against them; and have
you then there this writ.

& offered to read to him the writ & declaration
in the presence of the said Cabanil which he
refused to hear & acknowledge the service
of the none in the city of St Louis
