Augustus Chouteau John P. Canne & Antoine
Chenin by Carr their attorney complain of Henry DeLauseur
Alexander Papin Joseph Robedeau & Francoise Robedeau in
a plea of trespass on the case for that whereas on the twenty
ninth day of June in the year of our Lord one thousand eight
hundred thirteen at the county aforesaid & within the juris
diction of this court, it was agreed by & between the plaintiffs and
defendants, that they the said plantiffs should sell and deliver
to them the said defendants all the goods &
merchandizes & other articles which they the said
plaintiffs had in the possession of their clerk one
certain Bazile Buissonette up the Missouri river
at the Maka nation of Indians, as well the goods
wares & merchandizes which were left with said Buizonet
not by Joseph Brazeau for the plaintiffs as those
which had been placed under the particular direction
& care of said Buissonet himself by them the said
plaintiffs, whereof an invoice together with the agree
[-]ments of the parties are as follows Towit -

depart d'ics - Nota - Il est been entendu que Augte
Chouteau Cabanne &Co . ne s'obligeant pas afaire livres
les sus dites marchandizes exactement aux factures
cy dessous detailles, mais bien generalment toales
celles que se trouveront entre les mains du
Bazil Bissonet tant celles que lui a quittes Jph Bra
-zea que celles qu'il aura de reste. Les sus dites
marchandizes seront livres l'arrivee de Mrs.
J. Robedeaux, A . Papin & Co . ou leurs representatifs
. chez les machas a l'endroit ou le secver Bazil Buis

and the said plaintiffs aver that out of the goods wares &
merchandizes aforesaid these summoned in the hands
& popission of said Buiponette for the plaintiffs Ar
[-]ticles to the price & amount of six thousand four hun-
dred & forty two dollars & eight cents according to
the price contained in the foregoing invoices, which
were delevered to them the said defendants, by him
the said Bazil Buiponette for the plaintiffs at
fort Je Loiseau Noiz the twenty sixth day of
september in the said year of eighteen hundred &
thirteen, Towit at the county aforesaid & within the juris
diction aforesaid, by reason as on where of the said defendants
became liable & found in law according to their agreement
& asumpsit in writing as aforesaid set forth, to pay them
The said plaintiffs the amount of said merchandeses
aforesaid Towit the sum of six thousand, four hundred
& forty two dollars, eight , wherever after the expera
tion on of the month of may eighteen hundred & four
[-]teen the same should be demanded and being so
liable in consideration thereof then & there undertook
& faithfully promisedto pay the said sum of money
to the plaintiffs according to the and effect of
their saidasumpsit in writing -

and for that whereas the said defendants on the twenty
sixth day of September eighteen hundred & thirteen at
fort de Loiseau Noiz , towit at the county aforesaid &
within the jurisction of this court those indebeted to
them the plaintiffs in the sum of six thousand dollars
for goods & wares & merchandizes before that time sold
& delivered to them the said defendants at their special
instance & request, and being so indebeted in consider
ation thereof then & there undertook & faithfully prom
[-]ised to pay the same to the plaintiffs wherever after
[-]wards they should be requested -

and for that whereas also the said defendants on
the same day & year aforesaid at the place and within
the jurisdiction aforesaid,in consideration that the said
plaintiffs had before that had timesold and delivered to them
at their like special instance &request, other goods,
wares &merchandizes, they promised to pay them there
for so much as the said goods wares &merchandizes
were reasonably worth, and the said plaintiffs aver
that the goods wares &merchandizes
tinred were reasonably worth the sum of six
thousand dollars of which the defendants then
& there had notice, by reason whereof they became
liableto pay the saidsum of money to the
plaintiffs as requested-

Nevertheless the said defendants tho often req-
uested have not paid the aforesaid several sums
of money nor any part thereof to the plaintiffs, but
the same topay hath wholy & state do the
refuse to the damage of the plaintiffs seven
thousand dollars therefore they sue &c.

between the hours of nine in the forenoon & Six of the Clock in the afternoon
of that day it being the Third tuesday of said month of Auguste Before
me Mary F. Ledue One of the Justice of the Peace in & for the township of
St. Louis County of St Louis & Territory of Misssouri at my office in St. Louis
on the day & year last aforesaid personaly came & appeared Bazil .
Bisounet who being duly sworn On the Holy Evangelistsof almighty
God deporeth & sayth that in September last to wit 1813 at the fort commonly the fort of L'Oiseau noir at the nation Mahas he the deponent was called
upon by Henry Delaurier Francois Robidou & Alexander Papin to deliver them
the goods wares & Merchandizes, that he the deponent asked them their authority
to which they replied “you know that we have property as for letters we have
none, nevertheless on their insisting of having the goods which he the deponent
let them have, on telling them well take them, that they the said Papin
together with one of his hands began to measure & Weigh the said goods
wares & Merchandizes that he the said deponent did not in any
wise in the measuring and weighing of the same he considering it as
a , that when said Papin was taking the said goods & Merchandizer
Francois Robidou was taking a memorandum or statement of the same
in writing, that he was hired to trade the said goods wares & Merchandize,
that he amongst his hired honor he had one who could write to whom he
ordered to attend to the taking of the goods but did not - that in the taking
of the said goods wares and Merchandizes they the said Alexander Papin Francis
Robidou & Henry Delaurier as he the said deponent couldnever cheated
him, that when in the taking of the goods he the deponent first opened the
Bales and wanted to count the blankets when it was observed to him by
the said Alexander , Francis & Delaurier that there would be a confusion in counting then among People, that after the memorandum of
the said goods, wares & Merchandizes was taken he the deponent observed for
them one mistake to wit about one hundred and two or one hundred & three years of Callicere or about one pair and a half or two pairs or two pairs and a half of small Blankets remaining - which items
were afterwords carried on said Memorandum or statement

Question by Plantiffs. Did you or did you next trade any selver wares

Answer I did not trade any & it all remained in the same trunk I got

Q. who would you perceive of the mistake of the & Blanketts and
of no other mistake.

A. Because this & Blanketts were all show of that kind, but amongest such a quantity of goods I would not remember every item

Q. how many maps of had you ? Answer about as I think six but
that in the taking of the same Alexander Papin wanted to take them out
for four and that on my insisting insix the said Alexander as well as myself and that they set them down

Q. by same to wit the Plantiffs. Did you heard said Alexander , Francois & Delaurier expressing any thing about the payment of the goods?

A. Yes they expressed that they would pay you on the Bank of the river
on their arrival here, & that if thesaid Plantiffs would not here it so they the said Defendants would by the course of law detain the
payment of the same for month or one year

Q. by same what losely at Mr. Auguste Chouteau relating to
an Invoice and a letter?

A. at that place Mr. Cabauné asked me how could I deliver the goods
without the letter & Invoice to which I answered that they Robideaux

Question by plaintiff attorney was there any other person who could read
but the Defendants - Answer yes several others
Question by same. Did you sign the said invoice knowing it to be
incorrect - Answer Yes -

Question by same You have said that your considered the taken of the
said goods wares & merchandises by the said Defendants how did it
happened that you signed the invoice ?

Answer I was to situated that I could not do otherwise.
question by same. You have said that you considered that the taken of
the goods by the Defendants as a pillage or plundering, was there
any threat, force or violence used on their part to induce you to belief
it? Answer, there was no threat, force nor violence used an
their past, but I was so circumstanced that I was obliged to let
the goods to them

Question by same. were you afraid of them Answer Yes
Question by same. were there any persons present at that time to wit
when the goods were delivered who could prevent the Defendants from during
you from taking the goods by force and if any how many?
Answer - there were persons present but not remember who
they were.

Question by same, was the said invoice made & signed by you
at the time the goods were delivered. Yes the said invoice was
signed by me at the delivery of the said goods.

Question by same how many man hard you then of yours-
Answer two -

And this deponent further sayth not

Taken sworn to subscribed before me on the day & year & between
the hours and at the place in that behalf written

and Papin told me they would not delivered me the letter
concerned my wages that the said letter was Damaged & to that it was
altogether , and this deponent states that the letter was defaced the
Invoice in which said letter wasappeard very sound - and this deponent
further says that joseph Robideau told him since the commencement of the present
suit that it he the said Deponent would say that he had been cheased by them
he the said Joseph or his would flogg him -
that he the said Deponent would say that he had been cheatedby them
he the said Joseph Robideau or his brother would flogg him----
that he the said deponent repeated to the said Defendant at Mr. Chouteau
that he had been cheated by them,adding the said deponent that the of
nine hundred Dollars could not have occured on the small trade he made
of part of the said goods with the Indians

Question by Defendant's attorney, Did or did not Alexander Papin , Francois Robideau
and Henry Delaurier or either of them showed you any instrument of writing
or any paper purporting to be on Invoice or any letter?

A. They showed me a Paper but as I can neither read nor write I do not
know what the contents of it might be and could not know it one hour after
were the same presented to me.

Q. by same In what capacity were you employed by the said Plaintiffs
in this case Answer in the Capacity of Clerk & trader for them the said
Plaintiffs -

Q. Did you of did you not considered yourself accountable for the
goods wares & merchandizes which were confided to you in that Capacity?

Answer, yes but in no otherwise that by my neglect -

Q. by same - Did you make or came to be made any Invoice of the goods
wares & merchandizes related above which you delivered to the above
named Defendants? Answer. I did not made any but Francois
Robideau made one Invoice -

Q. Did you signed & acknowledged the Invoice made by said
Francois Robideau ? Answer, yes through ignorance. -

Q. did any person witnessed your signature and if any one who?
